You need a sworn affidavit to support transfer of a vehicle's Registration Certificate into a new owner's name at the RTO — after a sale, or after the death of the registered owner — where the Registering Authority asks for a sworn statement beyond the plain transfer forms, or where a fact needs to be put on record that Form 29 and Form 30 themselves have no box for: that the person signing really is the registered owner or a legal heir entitled to the vehicle, that dues on it are cleared, and whether any financier's hypothecation still needs to be cleared before the transfer can go through. Transfer of ownership is governed by Section 50 of the Motor Vehicles Act, 1988 and the Central Motor Vehicle Rules, 1989, which apply uniformly across India; what is jurisdiction-specific here is the authority you file before — in Punjab the Sub-Divisional Motor Vehicle Officer or District Transport Officer of the district, in Chandigarh the Registering Authority, Union Territory of Chandigarh — and where this affidavit is notarised.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. Stamp duty

An affidavit is chargeable under Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, which Schedule also governs the Union Territory of Chandigarh. In practice it is sworn on a non-judicial stamp paper of the smallest denomination generally sold at a treasury, an SHCIL e-stamp counter or an authorised stamp vendor in Punjab or in Chandigarh; the Parivahan portal's own online workflow commonly asks for an affidavit of this kind to be uploaded as a scanned document rather than produced in original at the counter. Punjab's Schedule 1-A rates for a list of instruments including affidavits have been revised by notification from time to time, and the exact rupee figure now in force was not independently confirmed for this template — confirm it at the stamp vendor on the day of purchase.

Registration

This affidavit goes into the transfer file with Form 29 and Form 30 and is not an instrument the Registration Act, 1908 requires to be registered, in Punjab or in Chandigarh — a sworn statement supporting a change of ownership is not among the categories Section 17 of that Act reaches. "Registration" of the vehicle itself is the separate, Motor-Vehicles-Act sense of the word: the Registering Authority's own record of who owns it, changed under Section 50 of the Motor Vehicles Act, 1988 on Form 29 and Form 30, not under the Registration Act, 1908 at all.

Notarisation

Sworn or affirmed before a Notary Public or an Oath Commissioner appointed for Punjab or for the Union Territory of Chandigarh, who verifies the Deponent's identity and signs, stamps and dates the affidavit, before it is uploaded or produced with the transfer application.

Witnesses

This affidavit needs no separate attesting witness in either jurisdiction beyond the notarial attestation.

RC TRANSFER AFFIDAVIT

I, Baljit Singh, son of Kartar Singh, aged about 52 years, resident of House No. 18, Urban Estate, Patiala 147002, holding Aadhaar 4444 5555 6666, applying within the State of Punjab (the "Deponent" or "I"), do hereby solemnly affirm and declare as follows:

  1. 1. MY INTEREST IN THE VEHICLE

1.1 I am the registered owner of the Vehicle described below and the Transferor in this transfer. I confirm that every tax, insurance premium, challan and other due on the Vehicle up to the date of this Affidavit is my responsibility, and none remains outstanding except as separately disclosed.

1.2 I make this affidavit for filing before SDM-cum-Registering & Licensing Authority, Patiala, in support of transfer of the Registration Certificate of the Vehicle described below.

  1. 2. THE VEHICLE

2.1 Particulars of the Vehicle: make and model Honda City VX, petrol, registration number PB11 AX 9021, chassis number MAKGM8GG0K0034521, engine number L15Z1876543, presently standing in the Registration Certificate in the name of Kartar Singh.

  1. 3. THE TRANSFER

3.1 The Vehicle is being transferred to Amarjit Kaur, of House No. 9, Model Town, Patiala 147001 (the "Transferee").

3.2 The Transferor sells the Vehicle to the Transferee for consideration, as recorded in a separate sale agreement or receipt.

3.3 Further particulars: Sale agreement dated 3 September 2026 for Rs 4,20,000, full payment received.

3.4 The other legal heirs of the deceased registered owner, and their relationship to the deceased, are: Jaswinder Kaur, widow of the deceased; Ravinder Singh, son of the deceased — both consent to this transfer.

3.5 To the best of my knowledge, information and belief, there is no dispute or pending litigation concerning ownership of the Vehicle, and no person other than the Transferee, and any other legal heir named above, has any claim to it.

  1. 4. HYPOTHECATION

4.1 The Vehicle is free from any hypothecation, loan or charge, and its Registration Certificate shows no financier's name.

  1. 5. DECLARATION

5.1 Every statement made above is true to my own knowledge, information and belief, and I have concealed nothing material to this application. I am aware that furnishing false information to the Registering Authority is an offence under the Motor Vehicles Act, 1988, and that the transfer sought is liable to be refused, or reopened, if any statement made here is found false.

VERIFICATION

Verified at Patiala on 1 April 2026 that the contents of paragraphs 1 to 5 above are true and correct to my own knowledge, that no part of it is false, and that nothing material has been concealed.
