When you need it

Use this when a farmer sells a crop that is still standing in the field, such as maize, sugarcane, green fodder, potato, vegetables or a fruit crop, to a buyer who will harvest it and carry it away. It records the field and the crop, the price (as one lump sum or at a rate on the quantity actually harvested), the advance, the date by which the buyer must harvest and clear the field, who bears the loss if the crop is damaged before harvest, and what happens if the buyer does not harvest in time.

The buyer gets the crop, not the land: no right to the field or to possession of it is given beyond entering to cut and carry the crop within the time allowed. Not for: a sale of the land itself (use the Agreement to Sell Agricultural Land); an arrangement where the buyer supplies seed and inputs and promises to take the crop at a fixed rate (use the Contract Farming Agreement); a share-of-crop arrangement with a cultivator (use the Batai Crop-Share Agreement); a sale of apple crop in Himachal Pradesh (use the Himachal Apple Crop Sale Agreement).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A sale of a crop is a sale of goods, not of land, so no conveyance duty is charged. A general agreement may attract a fixed duty under the residual agreement entry of the Punjab or Chandigarh schedule, and this drafter could not confirm one current figure, so none is stated. A simple receipt for an advance is commonly given with a revenue stamp where the amount is over the threshold in the Indian Stamp Act, 1899. Ask on the official e-stamping portal or at the Sub-Registrar counter before signing.

Registration

Not registrable. A sale of a standing crop that is to be cut and removed is a sale of goods, and no interest in the land passes, so section 17 of the Registration Act, 1908 does not apply.

Notarisation

Not required. Either party may have it notarised for extra comfort that the signatures are genuine; carry original photo ID.

Witnesses

Not required by law, but two adult witnesses who are not parties are customary in village practice and are provided for below.

AND

Rajinder Kumar, of Mandi Samrala, District Ludhiana, mobile 98140-00000 (the "Buyer").

  1. 1. THE CROP

1.1 The Seller sells and the Buyer buys the Maize now standing on an area of 5 acres (40 kanal) of the Seller's land at Village Rurki, Tehsil and District Samrala, Ludhiana, khewat / khatauni and khasra (killa) numbers: Khewat 27, Khatauni 44; Khasra 19//12, 19//13 (the "Crop").

1.2 The Seller states that the Crop is his own, free of any pledge or claim of another person, and that no one else has been promised it.

  1. 2. PRICE AND PAYMENT

2.1 The price is ₹90,000 (Rupees Ninety Thousand only), fixed as a lump sum for the whole crop on the area stated above.

2.2 The Buyer has paid ₹20,000 (Rupees Twenty Thousand only) in advance today, and the Seller acknowledges it. It will be set off against the price.

2.3 The balance is payable as follows: Before the first load leaves the field. The Seller shall give a receipt for every payment.

  1. 3. HARVEST AND REMOVAL

3.1 The Buyer shall harvest the Crop at his own cost and risk, with his own labour and vehicles, and shall finish and clear the field by 2 April 2026 (the "Last Date").

3.2 The Buyer may enter the field only to cut and carry the Crop within that time. He shall not damage the field bunds, watercourses, tubewell, trees or other property of the Seller, and shall not graze animals or stack material on the land beyond what harvesting needs.

3.3 The Seller keeps possession of the land throughout. This agreement gives the Buyer no lease, tenancy or other right in the land.

4.2 Once the Buyer has cut the Crop, it is at the Buyer's risk. Any compensation or insurance money for loss to the Crop before harvest belongs to the Seller unless the parties agree otherwise in writing.

4.3 The Buyer shall not burn any crop residue left on the land in breach of any law or order for the time being in force.

  1. 5. DISPUTES

5.1 The parties shall first try to settle any dispute by talking, if they wish with the help of respected elders or the village panchayat.
