When you need it

Use this when one farmer owns a tubewell (or borewell) and agrees to let a neighbouring farmer draw irrigation water from it for the neighbour's own land, in turns or in a share of the running hours, and wants the terms in writing: the season, the turns, who pays the electricity and the repairs, and how the water reaches the neighbour's field. It is a personal permission for the period named, not a sale of the tubewell or the water, not a lease of any land, and not a permanent right of way or water.

When the period ends, so does the permission. Not for: moving the electricity connection to another name (use the Tubewell Electricity Connection Transfer Affidavit); leasing farmland with its tubewell (use the Agricultural Land Lease); a share of the crop (use the Batai Crop-Share Agreement).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is charged on this agreement as a conveyance or a lease, because it transfers no land or other immovable property. A general agreement may attract a fixed duty under the residual agreement entry of the Punjab or Chandigarh schedule, and this drafter could not confirm one current figure, so none is stated. Before signing, ask on the official e-stamping portal or at the Sub-Registrar counter whether any duty applies, and use stamp paper of the value named. An under-stamped paper cannot be used as evidence until the deficit and penalty are paid.

Registration

Not compulsorily registrable: this agreement creates no interest in immovable property, so section 17 of the Registration Act, 1908 does not require it to be registered. The parties may still choose to register it for extra evidential weight.

Notarisation

Not required. Either party may have it notarised for extra comfort that the signatures are genuine; carry original photo ID.

Witnesses

Not required by law, but two adult witnesses who are not parties are customary in village practice and are provided for below.
