When you need it

Use this when a farmer engages a farm worker, called a seeri in Punjab, for a year or a season to work on the farm for wages, usually paid in cash with some grain, food or a place to stay. It puts in writing the work, the hours, the cash wage and the extras, when wages are paid, leave and rest, what happens if the worker is hurt or falls ill, and how either side may end the engagement.

It is written so that the worker stays a free person. Any advance the farmer gives is an ordinary loan, carries no interest here, binds the worker to nothing, and cannot be a reason to keep him from leaving. The law forbids bonded labour, and this agreement says so plainly so that neither side can later claim otherwise. Not for: a contractor who brings his own gang for a job (use the Labour-Only Contract, Thekedar Agreement); sharing the crop instead of paying wages (use the Batai Crop-Share Agreement); a domestic helper at a home.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This is a simple engagement of work for wages and conveys no property. This drafter could not confirm that Punjab or Chandigarh charge any stamp duty on a plain agreement of this kind, so none is stated. It is usually written on plain paper; if any office asks for stamp paper, ask which article it says applies before buying it. Keep the signed original with the Worker and a copy with the Farmer.

Registration

Not registrable: a contract of work for wages creates no interest in immovable property, so section 17 of the Registration Act, 1908 does not apply.

Notarisation

Not required. Either party may have it notarised for extra comfort that the signatures are genuine; carry original photo ID.

Witnesses

Not required by law, but two adult witnesses who are not parties, ideally one from the Worker's side such as a relative or the village sarpanch or panch, are sensible and are provided for below. Read the agreement aloud to the Worker if he cannot read.

FARM WORKER (SEERI) AGREEMENT

This agreement is made at Village Rurki, Tehsil Samrala on 2 April 2026.

BETWEEN

Nirmal Singh, of Village Bhatian, Tehsil Samrala, District Ludhiana, mobile 98140-00000 (the "Farmer");

AND

Jagtar Singh, son of Mal Singh, of Village Bhatian, Tehsil Samrala, District Ludhiana, mobile 98140-00000 (the "Worker").

  1. 1. THE ENGAGEMENT

1.1 The Farmer engages the Worker, and the Worker agrees to work on the Farmer's farm, from 1 April 2026 to 2 April 2026 (the "Period"), doing this work: Ploughing, sowing, irrigating, harvesting and looking after the cattle on the farm at Village Bhatian.

1.2 The Worker states that he is an adult, over eighteen years of age, and is entering this agreement of his own free will, having understood it.

1.3 The Worker works under the Farmer's reasonable instructions on the farm. The Farmer shall not make him do work that is unsafe or unlawful, or work for any other person.

  1. 2. WAGES

2.1 The Farmer shall pay the Worker a cash wage of ₹15,000 (Rupees Fifteen Thousand only) each month, on or before day 5 of the following month, and shall give a signed receipt, or note the payment in a register that the Worker can see.

2.2 The wage shall not be less than the minimum wage for farm work that applies to the Worker under the law for the time being in force. If it ever is, the minimum wage is the wage.

2.3 In addition to the cash wage, the Farmer shall give the Worker: Two meals a day on working days, a room in the farm house, and 20 quintals of wheat at the rabi harvest.

  1. 3. HOURS, REST AND LEAVE

3.1 Working hours and weekly rest: Eight hours a day with a rest break, and one day off in each week. In the busy sowing and harvest weeks, extra hours may be worked by agreement, and the Farmer shall pay extra for them at a rate agreed with the Worker beforehand.

3.2 The Worker has 12 days of paid leave in the Period, apart from the weekly rest and the public festivals on which the farm is closed. Unused leave is paid out at the end of the Period.

  1. 4. ADVANCE: NO BOND

4.1 The Farmer has given the Worker an advance of ₹20,000 (Rupees Twenty Thousand only), and the Worker acknowledges it. It is an ordinary loan with no interest. It shall be repaid as follows: By a deduction of one thousand rupees from each month's wage, at the Worker's choice and not more than a quarter of any month's wage.

4.2 No advance, loan or debt, now or later, binds the Worker to work for the Farmer, stops him leaving, or may be worked off by his labour or his family's. Any advance may be recovered only as an ordinary debt in the manner the law allows, and never by forcing the Worker or any member of his family to work or by keeping them on the farm against their will.

4.3 The Worker is free to leave at any time on the notice in clause 6. The Worker's family is not bound to work for the Farmer, and the Worker's children shall not be made to work on the farm in place of school.
