When you need it

Use this when a broker wants to pay a friend, past client or contact for introducing someone who then buys, sells or rents through the broker, and wants it written so the fee is not later argued about. It fixes the fee, the period in which a deal earns it, that it is paid only out of brokerage actually received, and that the introducer does no brokering and takes no money.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty is charged on an agreement of this kind under the Indian Stamp Act, 1899 as it applies in Punjab and Chandigarh. It creates no interest in property, so it is not stamped as a deed of sale or lease; confirm the article and amount at the e-stamp counter and stamp it before signing.

Registration

Not registrable as a matter of course: it creates no right of ownership or lease in the project. Registration is optional.

Notarisation

Not required.

Witnesses

Two witnesses are recommended; they help prove signing.

REFERRAL FEE AGREEMENT

A fee a broker pays a person who introduces a client, only if a deal results

Executed at Mohali on 1 April 2026.

Parties

1. The Broker — Rajinder Kumar Bansal, trading as Bansal Property Consultants, of SCO 22, Phase 3B2, SAS Nagar (Mohali), Punjab 160059, mobile 98765 43210, email name@example.com ("the Broker").

2. The Referrer — Harvinder Singh Dhillon, of House No. 61, Sector 40-C, Chandigarh 160036, mobile 98765 43210, email name@example.com ("the Referrer").

1. The referral

1.1 The Referrer introduces Harpreet Kaur Gill ("the Referred Person"), who wishes to buy a property.

1.2 About the lead: A three-bedroom flat in Mohali, budget about Rs 85 lakh

1.3 The Referrer confirms that the Referred Person has agreed to be contacted by the Broker and to have the details above shared with the Broker.

2. What the Referrer does and does not do

2.1 The Referrer only introduces the Referred Person. The Referrer does not negotiate, show property, give advice or make any statement or promise about price or any property on the Broker's behalf, and takes no money from the Referred Person or from anyone else for the transaction.

2.2 The Referrer is not the Broker's employee, partner or agent.

3. The fee

3.1 If, within 180 days of the date of signing, the Referred Person completes a transaction of the kind named above through the Broker, and the Broker receives brokerage on it, the Broker will pay the Referrer 20 per cent of the brokerage the Broker actually receives ("the Fee").

3.2 The Fee is payable only out of brokerage the Broker has actually received. The Broker will pay it within 7 days of receiving the brokerage, with a short statement of what was received.

3.3 No Fee is payable if no transaction results, if the brokerage is not received, if the Referred Person had already been in touch with the Broker about the same matter before this introduction, or if the Referrer is paid by the Referred Person for the same introduction.

3.4 The Broker will deduct tax at source and make other deductions that the law requires. Each party is responsible for tax on what it receives.

4. General

4.1 The Broker alone decides whether, how and on what terms to deal with the Referred Person, and is not bound to enter into any transaction.

4.2 The Broker will keep the Referred Person's details private and use them only for this transaction.

4.3 This agreement is governed by the law in force in Punjab, and the courts at SAS Nagar (Mohali) alone may decide a dispute about it.

4.4 This agreement may be changed only in writing signed by both parties.
