When you need it

A small supplier in Punjab or Chandigarh (a manufacturer or service provider registered as a micro or small enterprise on the Udyam portal) has delivered goods or services and the buyer has not paid within the time the law allows. This is the supplier's own demand notice to the buyer, asking for the unpaid amount with the interest the law gives on delayed payment, and warning that the supplier will go to the Micro and Small Enterprises Facilitation Council if it is not paid.

It also carries a short covering letter that goes with the supplier's reference to the Council. The Samadhaan filing itself is made online on the government portal in the portal's own form and with its own uploads. It is separate from this document. This paper gives you the notice that comes first and the covering letter and list of papers to put with the online filing; it does not copy the portal's form. Read the portal's current instructions before you file. The special payment rule helps only a supplier that held a valid Udyam registration at the time of the contract or supply. It does not help a buyer-supplier dispute between two ordinary businesses, or a medium or large supplier. Not for a general notice for non-payment of a loan or a cheque (use the Legal Notice for Recovery of Money, or the cheque notice).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

PART A: NOTICE DEMANDING PAYMENT OF DELAYED DUES

Subject: Notice for payment of ₹7,35,000 (Rupees Seven Lakh Thirty Five Thousand only) with interest for delayed payment, under the Micro, Small and Medium Enterprises Development Act, 2006.

Dear Sir or Madam,

  1. 1. We, Grewal Steel Fabricators, are registered as an enterprise under the Udyam registration system, registration number UDYAM-CH-01-0012345, first issued on 1 April 2026, and we are a micro or small enterprise supplier within the meaning of the above Act. Our registration was in force when the order or contract and the supplies below were made.
  1. 2. We supplied you the following: Fabricated steel frames and brackets supplied under the buyer's purchase order no. BEW/PO/118 dated 5 January 2026.
  1. 3. The following invoices remain unpaid: Invoice GSF/26-27/041 dated 12 January 2026, Rs 4,25,000, goods delivered and received on 14 January 2026. Invoice GSF/26-27/058 dated 2 February 2026, Rs 3,10,000, goods delivered and received on 4 February 2026.
  1. 4. The total principal still unpaid is ₹7,35,000 (Rupees Seven Lakh Thirty Five Thousand only), after taking into account ₹0 (Rupees Zero only) already received from you against these invoices. The goods and services were delivered and accepted by you, and you have not raised any objection to their quality or quantity in writing.
  1. 5. Under the Act, a buyer must pay a micro or small enterprise supplier on or before the date agreed in writing between them, which cannot be more than forty-five days from the day of acceptance or deemed acceptance of the goods or services, and where no date was agreed, within fifteen days of that day. The payment period agreed between us was 30 days from delivery (nil meaning nothing was agreed in writing). Payment on all the invoices above fell due long ago.
  1. 6. Under the Act, a buyer that does not pay by the due date is liable to pay compound interest, with monthly rests, on the unpaid amount from the due date until payment, at three times the bank rate notified by the Reserve Bank of India, and this applies despite any agreement to a lower rate. We claim that interest from the due date of each invoice until the date of payment, and reserve the right to calculate it in full. The amount of interest is in addition to the principal.
  1. 7. We therefore call upon you to pay us the principal of ₹7,35,000 (Rupees Seven Lakh Thirty Five Thousand only) together with interest as above, within 15 days of receiving this notice, by bank transfer to the account shown on our invoices. If you dispute any invoice, tell us in writing within the same time, giving your reasons and proof; silence will be taken as admission of the amount.
