When you need it

For completing the sale of one floor of a house built floor by floor, with the whole price paid on or before registration. A builder floor passes as the floor plus an undivided share of the land under the building, so the deed names the land share, who holds the roof rights, and the common staircase, passage and parking.

This is the document that moves ownership; until it is stamped and registered the buyer is not the owner. Freehold property only. Not for a whole house or a society flat (use the Sale Deed (Bainama)), a leasehold Chandigarh site (use the Deed of Transfer of Lease Rights), a sale signed through an attorney (use Sale Deed Signed through an Attorney), or a sale where the price is paid in instalments (use the Agreement to Sell with Instalment Terms).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Duty must be paid on or before signing, on the higher of the price and the Collector rate; for a built floor that is normally the land rate plus a construction rate adjusted for age. PUNJAB: 5% duty plus 1% Social Infrastructure Cess, 1% Punjab Infrastructure Development Board fee and 0.25% Special Infrastructure Development Fee, 7.25% in all; registration fee 1% (cap Rs 2,00,000); facilitation charge Rs 1,000, 3,000 or 5,000 by price band; pasting fee Rs 200. A woman buyer gets a two-point reduction on the duty alone. CHANDIGARH: 5% of the same value; registration fee 1% (cap Rs 10,000); pasting fee Rs 20; no concession for women buyers. Confirm the Chandigarh figures at the Sub-Registrar's office, Sector 17, before paying. An instrument not duly stamped is not admitted in evidence and will not be registered.

Registration

Registration is compulsory. Present the deed within four months of signing; every seller must appear and admit signing, with photographs and fingerprints taken, and the buyer should attend too. An unregistered sale deed does not pass ownership.

Notarisation

Does not replace registration. Execute and register the deed; notarise only an affidavit that goes with it if the office asks.

Witnesses

Two witnesses, with their own photo identity. In Chandigarh the first witness must be of a kind the Punjab Registration Manual accepts, such as an advocate, a gazetted officer or a councillor, and known to the Sub-Registrar.

Where more than one person is named as Seller or as Buyer, each of them is bound by this deed jointly and separately.

RECITALS

The Seller owns Second floor, covered area about 1,100 sq. ft. of the building on the plot at House 1234, Sector 20-C, Chandigarh, measuring 250 square yards, with One-third undivided share in the plot in the land under the building (the "Floor"), which the Seller got through Registered sale deed dated 12 June 2015, Sub-Registrar, Chandigarh.

The parties signed an agreement to sell the Floor on 2 April 2026. This deed carries out that agreement and takes its place.

  1. 1. SALE AND PRICE

The Seller sells and transfers the Floor to the Buyer, absolutely and for ever, for the price of ₹95,00,000 (Rupees Ninety Five Lakh only), which the Seller admits having received in full, as follows: Rs 9,50,000 by bank transfer on 15 Oct 2026 (UTR 123456789012); balance by bank draft no. 004512 dated 20 Dec 2026.

The Collector-rate value of the Floor is ₹90,00,000 (Rupees Ninety Lakh only), and stamp duty has been paid on the higher of that value and the price.

Tax was deducted at source from the price and deposited as follows: Rs 95,000, deposited on 14 Dec 2026. The amount deducted counts as part of the price paid.

  1. 2. WHAT IS TRANSFERRED

The Floor is transferred with One-third undivided share in the plot in the land under the building and the Seller's right to use the common areas, which are Main gate, entrance, staircase, passage, water tank and meter room.

Roof rights: The roof rights above this floor are sold to the Buyer with the floor. Wherever roof rights pass, they are the right to use the roof and to build on it only as far as the sanctioned plan and the law allow.

Parking: Covered parking bay no. 2 in the stilt goes with the Floor.

The Buyer will not block or build over the common areas, and will bear a fair share of the cost of keeping them in repair.

  1. 3. POSSESSION AND PAPERS

Possession: Vacant possession of the Floor is handed to the Buyer today, with the keys. The Seller also hands over these original papers: Earlier sale deed, sanctioned plan, tax receipts, utility bills.

Loan or mortgage: No loan or mortgage is outstanding on the plot or the floor.

Building plan and occupation papers: Plan sanctioned 4 March 2012; occupation certificate 9 May 2014.

  1. 4. THE SELLER'S PROMISES

The Seller promises that the Seller is the full owner of the Floor and has the right to sell it; that it is free from any other sale, gift, mortgage, lease, court case, attachment or claim, except as written in this deed; and that all property tax, electricity, water, sewerage and maintenance dues up to the day of this deed have been paid.
