When you need it

Use this to file a consumer complaint before the District Consumer Disputes Redressal Commission when goods you bought were defective, or a service you paid for was deficient, and the seller or provider has not put it right. The papers are the complaint itself, with its cause title, an index, numbered paragraphs, a prayer and a verification, and the supporting affidavit.

Consumer complaints are usually filed through an advocate, who signs the complaint and attends the hearings, but a consumer may file and appear in person, and a complaint can be filed online through the e-Daakhil portal or at the Commission's registry. Answer the questions from your bill, your messages and your earlier notice. Which Commission can hear it depends on the value of the goods or services paid for and on where the opposite party works or you live; the limits, the fee and the form of filing are set by rules that change, so confirm them with the Commission's registry or the portal before filing. The complaint must be filed within two years of the cause of action. The affidavit must be sworn before a Notary Public or Oath Commissioner. Before this, a Notice for Faulty Product or Deficient Service is usual. Not for a dispute over medical treatment, a bank, a flight or a telecom service when a shorter route is available: see the other complaint documents in this section.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable on the complaint. A fee is payable on filing, fixed by rules made under the Consumer Protection Act, 2019 and graded by the value of the consideration paid; this document states no figure, because the figure changes, so confirm it with the Commission's registry or on the e-Daakhil portal. Any stamp needed on the affidavit is also confirmed at the registry.

Registration

Punjab and Chandigarh: not registrable. A complaint to a Commission is a proceeding and creates or transfers no right in immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it.

Notarisation

Punjab and Chandigarh: the supporting affidavit is sworn or affirmed before a Notary Public or an Oath Commissioner. The complaint carries the Complainant's own verification and is signed by the Complainant or the advocate.

Witnesses

Punjab and Chandigarh: no witness signs the complaint or the affidavit. Witnesses, if any are needed, give evidence before the Commission.

CONSUMER COMPLAINT

The Complainant respectfully states as follows:

  1. 1. The parties. The Complainant is a consumer within the meaning of the Consumer Protection Act, 2019. The Opposite Party is Bajwa Furniture House, who sold the goods or provided the service described below.
  1. 2. The transaction. The Complainant bought goods from the Opposite Party for personal use, and not for resale or any commercial purpose. On 1 April 2026 the Complainant paid ₹72,000 (Rupees Seventy Two Thousand only) by UPI transfer on 4 August 2026, against invoice No. BF/2026/932 dated 4 August 2026. A five-seater sofa set in solid sheesham wood and leatherette, delivered on 10 August 2026, sold with a ten-year frame warranty and a two-year upholstery warranty.
  1. 3. The defect or deficiency. Within three weeks the leatherette peeled off both armrests and one leg of the three-seater split along the joint, so the sofa rocks when anyone sits on it. The Complainant first noticed this on 2 April 2026.
  1. 4. What the Complainant did. I phoned the shop on 2 September 2026 and visited on 6 September 2026, when the manager promised a carpenter. No one came. I messaged on 14 and 22 September 2026, and the manager replied that the damage was caused by use. The Complainant also sent a notice, namely a notice dated 16 October 2026 sent by registered post, to which no reply was received.
  1. 5. The loss. The Complainant cannot use the sofa set, has lost working time waiting for the carpenter, and has had to borrow chairs for the household.
  1. 6. Jurisdiction. The Opposite Party carries on business or works for gain within the territorial jurisdiction of this Commission. The value of the goods or services paid for as consideration is ₹72,000 (Rupees Seventy Two Thousand only), which the Complainant submits is within the pecuniary jurisdiction of this Commission.
  1. 7. Limitation. The cause of action arose on or after 2 April 2026, and this complaint is filed within two years of it.
