When you need it

Someone has cheated you of money or property, threatened you, or harassed you or your family, in Punjab or Chandigarh, and you want the police to take it up. This complaint gives the officer in charge of the police station what is needed to act: who you are, who you complain against, exactly what happened and when, what you lost, who else knows, the evidence you hold and the steps you have already taken.

It asks for the information to be recorded as a first information report and for a free copy. It does not name sections of law; the police apply the ones the facts support. It can be given by you in person or through an advocate. If the officer will not record it, its substance goes to the Superintendent of Police, and then to the Magistrate, see the next two documents in this section. Use it for an incident on or after 1 July 2024. Not for a cyber or online fraud, which has its own complaint (Cyber Fraud Complaint); not for a cheque that bounced, which goes to the Magistrate (Cheque Bounce Complaint to Magistrate); not for trespass on property (Police Complaint for Trespass); and not for a lost article (Lost Article Report). A police complaint does not recover money or settle a civil dispute; that needs a civil suit or notice.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. The complaint is a letter to an authority; it creates, transfers or records no right in any property, and it is signed by the complainant alone.

Registration

Punjab and Chandigarh: not registrable. It is a letter to an authority and deals with no right in immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it.

Notarisation

Punjab and Chandigarh: no notary is needed. The complainant signs it. An affidavit is needed only later, if the matter goes to the Magistrate, who considers an application supported by affidavit.

Witnesses

Punjab and Chandigarh: no attesting witness signs it. Persons who saw what happened are named in it, with their addresses and telephone numbers, so that the police can record their statements.

Subject: Complaint about cheating by a dealer over a booked car: information of an offence, for recording as a first information report

Sir or Madam,

  1. 1. What this complaint is about. This complaint is about cheating, where I was deceived into parting with money or property. I do not name the sections of law that apply: I ask the officer to apply the sections that the facts disclose.
  1. 2. The persons complained against. The persons I complain against are Ravinder Singh son of Gurnam Singh, proprietor of Sunrise Motors, Ferozepur Road, Ludhiana, and a salesman who gave his name as Pappu. I refer to them together as the accused.
  1. 3. What happened. On or about 1 April 2026, Ravinder Singh took Rs 2,50,000 from me as the booking amount for a car, promised delivery within 30 days and gave a receipt. No car was delivered, the showroom is now shut, and he has stopped answering my calls.
  1. 4. The loss or harm to me. The loss or harm caused to me is Rs 2,50,000 paid as booking amount and not returned.
  1. 5. Witnesses and evidence. The matter, or part of it, was seen or is known to my brother Harjit Singh, House No. 14, Model Town, Ludhiana, 98760 22110. I hold the following evidence and will hand it to the investigating officer: the booking receipt, my bank statement showing the transfer, and WhatsApp messages from 12 June to 30 July 2026.
  1. 6. Steps taken so far. I sent a notice by registered post on 5 August 2026, which was not answered.
  1. 7. My request. Please record this information as a first information report under section 173(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023, give me a copy of it free of cost under section 173(2), investigate the offence, record the statements of the witnesses named above, and secure the records and articles listed in paragraph 5 before they are lost. If the facts disclose only an offence for which the police cannot register a first information report without an order, I ask that the information be entered in the station's register and that I be told in writing what further step is open to me. I hand this complaint in writing at the police station and ask that it be recorded in my presence.
  1. 8. If it is not recorded. If the information is not recorded, I will send its substance in writing by post to the Superintendent of Police under section 173(4) of that Sanhita, and if that too brings no action, I will apply to the Magistrate, who may order an investigation under section 175(3) after considering my application, supported by affidavit, and the submission of the officer in charge.
