When you need it

The police in Punjab or Chandigarh have seized your vehicle or other property in connection with a case, such as an FIR, and it is standing at the police station while the case goes on. If you are the owner or lawful possessor, you can ask the court dealing with the case to hand it back to you on superdari, meaning interim custody on a bond to produce it whenever called.

This application sets out your right to the property, the seizure and the stage of the case, why you need it released, and your undertaking not to sell, transfer or alter it and to produce it on demand. It asks for photographs and an inventory before release, and it carries the supporting affidavit. Court applications are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional). The court decides after hearing the police, and may ask for a bond and a surety (see the Surety Bond and Solvency Affidavit). Fix the court fee and the stamp on the affidavit at the filing counter. Not for property seized by a customs, excise, forest or tax authority, which has its own procedure. Superdari is not final: the court decides later who gets the property.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The court's own court-fee stamp, fixed by the court office, is payable on the filing; the amount is not given here because no single figure common to every court has been confirmed, so confirm the current figure at the filing counter of the court. The affidavit that goes with it is ordinarily exempt from the nominal affidavit duty under Article 4, Schedule I-A (Punjab) or Schedule I (Chandigarh) when filed in a pending court proceeding, and otherwise carries that nominal duty; confirm that at the counter too.

Registration

Punjab and Chandigarh: not registrable. It is lodged with the court's own registry, becomes part of the record of the case, and is not a document that the Registration Act, 1908 reaches.

Notarisation

Punjab and Chandigarh: the affidavit that goes with it is sworn before a Notary Public, an Oath Commissioner attached to the court, or the court itself, as for any other verified paper. The deponent appears in person with photo identification.

Witnesses

Punjab and Chandigarh: no attesting witness signs it. The signature of the party and, where an advocate files it, the advocate's signature are the whole formality. Court papers are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional).

IN THE COURT OF THE CHIEF JUDICIAL MAGISTRATE, LUDHIANA

APPLICATION FOR RELEASE OF SEIZED PROPERTY ON SUPERDARI (INTERIM CUSTODY)

In the matter of: FIR No. 214 dated 3 August 2026, Police Station Division No. 5, Ludhiana

Manjit Kaur, wife of Balbir Singh, aged 58, of House No. 221, Street No. 4, Gurdev Nagar, Ludhiana 141001 ... APPLICANT

VERSUS

The Officer in Charge, Police Station Division No. 5, Ludhiana ... RESPONDENT

MOST RESPECTFULLY SHOWETH:

  1. 1. The Property. The Applicant is the registered owner of Maruti Swift car, white, registration No. PB10 AB 1234, chassis No. MA3EWDE1S00123456, engine No. K12MN1234567 (the Property). Ownership is shown by the registration certificate in my name, the insurance policy and the purchase invoice.
  1. 2. The seizure. The police seized the Property on 1 April 2026 in connection with FIR No. 214 dated 3 August 2026, Police Station Division No. 5, Ludhiana. The case is under investigation and no challan has yet been filed. The Property is now at the yard of Police Station Division No. 5, Ludhiana.
  1. 3. The Applicant. The Applicant is not an accused in the case.
  1. 4. Why release is sought. I use the car to take my husband to dialysis three times a week, and it is deteriorating in the open yard in the sun and rain. The Applicant submits that the Property can be photographed, inspected and its particulars recorded, and that the Applicant can be directed to produce it whenever the Court requires, so that its release does not prejudice the investigation or the trial.
  1. 5. Undertaking. If the Property is released to the Applicant on superdari, the Applicant undertakes (a) not to sell, transfer, mortgage, alter or part with the Property, (b) to produce it before the Court or the police whenever called upon, (c) to keep it in the same condition, and (d) to furnish the bond and surety that the Court directs.
  1. 6. Earlier applications. No earlier application has been made. I asked the investigating officer on 20 August 2026, who said the Court must order the release.
  1. 7. Affidavit and enclosures. This application is supported by the Applicant's affidavit, which follows it. Enclosed: copies of the registration certificate, the insurance policy and the seizure memo.

PRAYER

It is therefore most respectfully prayed that this Hon'ble Court may be pleased to:

(a) release the Property to the Applicant on superdari, on such bond and surety as the Court directs;

(b) direct that the Property be photographed and an inventory of it prepared before it is released; and

(c) pass any other order that the Court considers just.
