When you need it

The police station in Punjab or Chandigarh would not register your first information report, you then sent the substance of your information to the Superintendent of Police, and still nothing has happened. The next step is an application to the Magistrate, supported by your affidavit, asking the court to direct the police to register the report and investigate.

This application sets out the offence, the information you gave and when, the complaint to the Superintendent and what came of it, why an investigation is needed, and the order you ask for, and it carries the supporting affidavit. It is the third step, after the Police Complaint (General) or another complaint to the police station, and the Complaint to the SSP: FIR Not Registered. Use it for an incident on or after 1 July 2024. Court applications are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional). Fix the court fee and the stamp on the affidavit at the filing counter. The application does not decide guilt; it only asks for an investigation.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The court's own court-fee stamp, fixed by the court office, is payable on the filing; the amount is not given here because no single figure common to every court has been confirmed, so confirm the current figure at the filing counter of the court. The affidavit that goes with it is ordinarily exempt from the nominal affidavit duty under Article 4, Schedule I-A (Punjab) or Schedule I (Chandigarh) when filed in a pending court proceeding, and otherwise carries that nominal duty; confirm that at the counter too.

Registration

Punjab and Chandigarh: not registrable. It is lodged with the court's own registry, becomes part of the record of the case, and is not a document that the Registration Act, 1908 reaches.

Notarisation

Punjab and Chandigarh: the affidavit that goes with it is sworn before a Notary Public, an Oath Commissioner attached to the court, or the court itself, as for any other verified paper. The deponent appears in person with photo identification.

Witnesses

Punjab and Chandigarh: no attesting witness signs it. The signature of the party and, where an advocate files it, the advocate's signature are the whole formality. Court papers are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional).

IN THE COURT OF THE CHIEF JUDICIAL MAGISTRATE, LUDHIANA

APPLICATION UNDER SECTION 175(3) OF THE BHARATIYA NAGARIK SURAKSHA SANHITA, 2023 FOR A DIRECTION TO REGISTER A FIRST INFORMATION REPORT AND INVESTIGATE

Manjit Kaur, wife of Balbir Singh, aged 58, of House No. 221, Street No. 4, Gurdev Nagar, Ludhiana 141001 ... APPLICANT

VERSUS

The Officer in Charge, Police Station Division No. 5, Ludhiana, and Ravinder Singh son of Gurnam Singh, proprietor of Sunrise Motors, Ferozepur Road, Ludhiana ... RESPONDENTS

MOST RESPECTFULLY SHOWETH:

  1. 1. The offence. The Applicant complains of cheating, in that Ravinder Singh took Rs 2,50,000 from me for a car he never delivered, and threatened my son when I asked for the money back. On or about 1 April 2026, Ravinder Singh took the money as a booking amount, promised delivery within 30 days and gave a receipt; no car was delivered and he stopped answering my calls.
  1. 2. Information to the police station. On 2 April 2026 the Applicant gave information to the officer in charge of Police Station Division No. 5, Ludhiana, in writing, by handing a written complaint to the duty officer. The duty officer refused to record the information and said it was a civil matter. The information was not recorded as a first information report.
  1. 3. Complaint to the Superintendent of Police. On 3 April 2026 the Applicant sent the substance of that information in writing by registered post, the postal receipt being enclosed to the Senior Superintendent of Police, Ludhiana, as section 173(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023 allows. No reply has been received and the police station has still not recorded the information.
  1. 4. Why an investigation is needed. The facts stated disclose a cognizable offence. A police investigation is needed because the accused controls the records and the showroom, and only the police can trace the money and secure the records.
  1. 5. Earlier applications and other proceedings. No earlier application has been made to any court on these facts.
  1. 6. Affidavit and enclosures. This application is supported by the Applicant's affidavit, which follows it. Copies of the information given to the police station and of the complaint to the Superintendent of Police are enclosed. Also enclosed: the booking receipt and the bank statement.

PRAYER

It is therefore most respectfully prayed that this Hon'ble Court may be pleased to:

(a) direct the Officer in Charge, Police Station Division No. 5, Ludhiana, under section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, to register a first information report on the facts stated above and to investigate them;

(b) direct that the Applicant be given a copy of the first information report free of cost; and
