When you need it

You gave the police station information about a serious offence, such as cheating, a threat, an assault or a theft, in Punjab or Chandigarh, and the officer in charge refused to record it as a first information report, or kept you waiting without action. The law lets you send the substance of the information in writing, by post, to the Superintendent of Police, who can investigate or have it investigated.

This complaint does that: it sets out the information you gave and when, what the police station did or refused to do, the evidence you hold and what you ask the Superintendent to do. It is the second step after the police station and comes before the application to the Magistrate (Application to the Magistrate to Order an FIR), which is the third. Use it for an incident on or after 1 July 2024, and only after you have first given the information to the police station, as the Police Complaint (General) or the Police Complaint for Trespass does. It does not decide guilt or recover money. Send it by post and keep the postal receipt, because you will need it as proof if you go to the Magistrate.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. The complaint is a letter to an authority; it creates, transfers or records no right in any property, and it is signed by the complainant alone.

Registration

Punjab and Chandigarh: not registrable. It is a letter to an authority and deals with no right in immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it.

Notarisation

Punjab and Chandigarh: no notary is needed. The complainant signs it. An affidavit is needed only later, if the matter goes to the Magistrate, who considers an application supported by affidavit.

Witnesses

Punjab and Chandigarh: no attesting witness signs it. Persons who saw what happened are named in it, with their addresses and telephone numbers, so that the police can record their statements.

COMPLAINT TO THE SUPERINTENDENT OF POLICE

To: The Senior Superintendent of Police, Ludhiana

Date: 3 April 2026

From: Manjit Kaur, wife of Balbir Singh, aged 58, of House No. 221, Street No. 4, Gurdev Nagar, Ludhiana 141001, telephone +91 98723 11418, email manjit.kaur221@example.com

Subject: Information of a cognizable offence given at Police Station Division No. 5, Ludhiana on 2 April 2026 and not recorded as a first information report: complaint by post under section 173(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023

Sir or Madam,

  1. 1. The information I gave. On 2 April 2026 I gave information to the officer in charge of Police Station Division No. 5, Ludhiana, in writing, by handing a written complaint to the duty officer at the counter. The information was about a man who took Rs 2,50,000 from me for a car he never delivered, and then threatened to harm my son when I asked for the money back. The persons concerned are Ravinder Singh son of Gurnam Singh, proprietor of Sunrise Motors, Ferozepur Road, Ludhiana, and the incident happened on or about 1 April 2026.
  1. 2. What the police station did. The duty officer refused to record the information, said it was a civil matter and told me to go to a lawyer. On 15 September 2026 I went again and was told the same. I was given this acknowledgement: a stamped copy of my complaint, diary No. 1822 dated 10 September 2026. The information has not been recorded as a first information report, and I have not been given a copy of any such record.
  1. 3. Evidence. I hold the following evidence and will hand it to the investigating officer: the booking receipt, my bank statement showing the transfer, and the threatening WhatsApp messages.
  1. 4. My request. Please consider the information, and if it discloses a cognizable offence, have it recorded as a first information report and investigated, either by you or by an officer subordinate to you, as section 173(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023 provides, and let me have a copy of the record free of cost. I ask that the officer in charge of the police station be directed to act on the information. I send this complaint by registered post with acknowledgement due, and I keep the postal receipt and the acknowledgement.
  1. 5. If no action follows. If this complaint too brings no action, I will apply to the Magistrate, who may order an investigation under section 175(3) after considering my application, supported by affidavit, and the submission of the police.
  1. 6. Other proceedings, and the truth of this account. Proceedings about the same matter are pending as follows: Consumer complaint No. 211 of 2026 before the District Consumer Commission, Ludhiana. What I have stated is true to my own knowledge, except where I say I was told it, and I have left out nothing I know about the matter. Enclosed: a copy of my complaint of 10 September 2026 with the station stamp, the booking receipt and the bank statement.
