When you need it

The flats or plots in a project have been sold or handed over, the builder has not helped the buyers form an association, and the buyers hold a first meeting. This resolution records that the meeting resolved to form an association, its name, who is the president and the secretary, that they are authorised to apply for registration, open a bank account and sign for the association, and that they will write to the promoter to form or help form the association and hand over the common areas and documents as the law requires.

The registration route (a society, or an association of apartment owners under the apartment law) and any number of members the law requires should be checked with the Registrar before the meeting. Keep the attendance sheet and notice of the meeting with the resolution. Not for an association that already exists and wants to change its office-bearers. RESOLUTION FOR THE FORMATION OF AN ALLOTTEES' ASSOCIATION

Minutes of the meeting of the allottees of Green Park Heights, Sector 82, S.A.S. Nagar (Mohali), held on 1 April 2026 at Community room, Green Park Heights, Sector 82, S.A.S. Nagar (Mohali).

Gurdeep Singh took the chair. 48 allottees were present, and the attendance sheet signed by them is attached.

The meeting noted that the project is being run by the promoter, ABC Developers Private Limited, and that the allottees have no association of their own. On the proposal of Navneet Sharma, seconded by Ravinder Singh, the following was resolved by 46 of the 48 present:

1. RESOLVED that an association of the allottees and owners of the project be formed, to be called Green Park Heights Allottees Welfare Association, to be registered under the Societies Registration Act, 1860.

2. RESOLVED that Gurdeep Singh be the President and Harpreet Kaur be the Secretary of the association until the first election under its rules.

3. RESOLVED that the President and the Secretary be authorised to prepare the rules of the association, apply for its registration, open a bank account in its name and sign the papers needed for these steps.

4. RESOLVED that the President and the Secretary write to the promoter to form, or help form, the association and to hand over the common areas, the common facilities and the project documents to it, as the real estate law and the apartment law require, and that they be authorised to approach the Real Estate Regulatory Authority and any other forum open to the allottees if the promoter does not act.

5. RESOLVED that every allottee or owner in the project may become a member of the association. The entry fee is ₹25,000 (Rupees Twenty Five Thousand only).
