When you need it

A worker in Punjab or Chandigarh has not been paid wages — for some months, for the last month after leaving, or for overtime or leave pay — and wants to complain to the labour department and ask for an order for payment. This is the worker's own letter of complaint.

It sets out who the employer is, what work was done, what was agreed, what remains unpaid, what the worker has already done to ask for it, and what the worker wants. The labour office may want the complaint or claim in its own prescribed form, or may need it on affidavit, or may ask that it be addressed to a particular officer or authority. This letter does not copy any such form; it says that the worker will fill the office's form if asked. Ask at the labour office, or look on the department's website, which authority and form apply to you, and keep the time limit in mind: a claim for wages can be brought only within the period the law allows after the wages fell due. Not the Legal Notice for Unpaid Salary or Dues, which is a demand sent to the employer before going to any authority; send that first if you can. Not for a claim by a group of workers through a union, which is raised differently.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Not chargeable to stamp duty under the Indian Stamp Act, 1899, in Punjab or Chandigarh — it is a letter, not an instrument that creates or transfers any right. Print it on the employer's letterhead. No court fee is normally charged for a wage complaint to the labour authority; ask the office whether it requires a fee or a stamp on any particular paper.

Registration

Not registrable. Section 17 of the Registration Act, 1908 has no application to a letter of this kind.

Notarisation

Not required. What matters is proof that it reached the other side: hand delivery against a signed acknowledgement, registered post, or a dated email. Keep that proof with the file.

Witnesses

None required.

  1. 3. My agreed wage is Rs 14,000 per month.
  1. 4. The employer has not paid my wages for June, July and August 2026. The total amount unpaid is ₹42,000 (Rupees Forty Two Thousand only). In addition, the following is also due: overtime for July 2026, Rs 3,500.
  1. 5. What I have done to ask for the wages: I asked the owner for my wages in person on 5 September and again on 20 September 2026, and sent a written notice on 1 October 2026. He promised to pay but has not.

  1. 7. I ask that you register this complaint, call the employer to give an explanation, and pass an order directing the employer to pay me the unpaid wages and any other amount that the law provides, together with such compensation or interest as the law allows, and take such other action as is just.
  1. 8. I understand that the office may require this complaint in its own prescribed form, or on affidavit, or may need further details or documents. I am ready to fill any form the office requires, and to appear and give evidence when asked.
  1. 9. The facts stated above are true to the best of my knowledge.

Papers enclosed: 1. Copy of appointment letter. 2. Bank statement showing last wage received. 3. Copy of my notice to the employer.
