When you need it

You are hiring a caterer or halwai in Punjab or Chandigarh for a wedding, party or other function, or you are the caterer and want the order in writing. This contract fixes the menu, the number of plates and the rate for each, what the rate includes, any extras, how much is paid in advance and when the rest falls due, and what happens if the guest count changes or either side backs out.

Most catering quarrels are about the final count and about what was "included". The contract therefore names the minimum number of plates, the date the final count is given, and the items the rate covers. Not for the venue itself — see the Marriage Palace or Banquet Booking Agreement, which says who provides the food. Not for a kitchen or canteen run for an institution over months.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

An agreement of this kind falls under the general entry for agreements not otherwise provided for in the stamp law, and the figure for Punjab and for Chandigarh is not confirmed here. Ask a stamp vendor or the Sub-Registrar office for the current figure before you sign. Many such bookings are made on plain paper; an unstamped paper can be questioned in court until the duty and any penalty are paid.

Registration

Not required. This agreement gives no right in land or buildings that outlasts the booking, so it does not need to be registered.

Notarisation

Not required. A notary adds nothing to the strength of this agreement.

Witnesses

Not required by law, but two witnesses who see both parties sign are good practice, and this form asks for them.

CATERER CONTRACT

This Contract is made at Chandigarh on 2 April 2026.

BETWEEN

Sharma Caterers, of Sector 40, Chandigarh, acting through Mukesh Sharma, Proprietor (the "Caterer");

AND

Harpreet Singh Gill, of House 118, Sector 21, Chandigarh, mobile 9876543210 (the "Host").

  1. 1. THE FOOD AND THE FUNCTION

1.1 The Caterer will cook and serve food for a wedding on 2 April 2026 at Royal Orchid Banquet, Sector 35, Chandigarh, ready to serve by 8:00 pm.

1.2 The menu is: Welcome drink; six starters; two dals; four vegetables; paneer dish; rice and pulao; naan and tandoori roti; three desserts; tea and coffee

1.3 The whole menu is vegetarian, and no meat, fish or egg is cooked or served.

1.4 The plate rate includes: Cooking, crockery and cutlery, serving staff, serving counters and cleaning of the cooking area

1.5 Extras, charged in addition to the plate rate: Live chaat counter Rs 15,000; extra waiter Rs 800 each

1.6 The Caterer will use fresh, good-quality ingredients, cook and keep the food hygienically, and hold every registration or licence the law requires of a food business, which the Caterer will show the Host on request.

  1. 2. PLATES, RATE AND PAYMENT

2.1 The rate is ₹850 (Rupees Eight Hundred and Fifty only) for each plate. The Host will give the Caterer the final number of plates in writing at least 5 days before the function.

2.2 The Host pays for the final number of plates, and in any case for not fewer than 300 plates. If more guests arrive than the final number, the Caterer will make reasonable efforts to feed them at the same rate, but is not bound to if the food is used up.

2.3 The Host paid ₹50,000 (Rupees Fifty Thousand only) as advance on 1 April 2026, and the Caterer confirms receiving it. The advance counts towards the final bill. The balance is paid on the day of the function, before service begins.

2.4 The plate rate and the extras already include every tax payable on them.

2.5 The Caterer will give the Host a written bill showing the plates served at the agreed rate, the extras and any tax.

  1. 3. QUALITY AND COMPLAINTS

3.1 If an item on the menu is not served, or food is unfit to eat, the Host may tell the Caterer's supervisor at once. The Caterer will replace the item if it can, and the parties will agree a fair reduction in the bill for whatever was not served or was unfit.

3.2 The Host will make sure the Caterer can reach the place, with water, a power supply and a place to cook and serve, from the time the parties agree in writing.

  1. 4. IF THE HOST CANCELS

4.1 The Host may cancel by written notice to the Caterer. If the notice reaches the Caterer more than 15 days before the function, the Caterer refunds 80 per cent of the advance. If it reaches the Caterer later, the Caterer refunds 30 per cent of the advance.

4.2 The Caterer pays any refund within 7 days of the written notice. The part of the advance that is not refunded is the parties' fair estimate of the Caterer's loss from the purchases and booking made for this function, and the Caterer claims nothing more because of the cancellation.
