When you need it

For when an arms licence holder has died and a legal heir wants the weapon put in the heir's name, or wants the Licensing Authority's directions for disposing of it: the heir's application to the Licensing Authority under the Arms Act, 1959 (in Punjab, the District Magistrate/Deputy Commissioner; in Chandigarh, the Licensing Authority notified for the Union Territory). It carries the heir's affidavit, including where the weapon is now and how it has been deposited or kept, and, where there are other heirs, their no-objection.

You choose Punjab or Chandigarh in the questions. Not for a living licence holder selling a weapon (use the NOC and Affidavit to Sell or Transfer a Licensed Weapon), and not for renewal. A legal heir certificate or an affidavit of legal heirship has its own documents.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17. Confirm the denomination with the vendor on the day of purchase.

Registration

Not a registrable instrument. The application and affidavit go into the Licensing Authority's file with the death certificate. There is no Sub-Registrar step. Whether the heir is also asked for a legal heir certificate from the revenue authorities is for the Licensing Authority to say.

Notarisation

Sworn or affirmed before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner appointed for Punjab or for the Union Territory of Chandigarh, who verifies the identity of each person signing and signs, stamps and dates the affidavit before it is filed.

Witnesses

None required by law beyond the notarial attestation. The other legal heirs sign Part C as signatories before the Notary, not as witnesses.
