When you need it

For a licence holder who wants to sell or give a weapon to someone else: a joint declaration by the seller and the buyer, addressed to the Licensing Authority under the Arms Act, 1959 (in Punjab, the District Magistrate/Deputy Commissioner; in Chandigarh, the Licensing Authority notified for the Union Territory). It carries the seller's no-objection, the weapon's particulars, and the buyer's declarations of fitness and licence position.

You choose Punjab or Chandigarh in the questions. Not for renewing an arms licence (use the Arms Licence Renewal Application and Affidavit), and not for a weapon after the licence holder has died (use Arms Licence Transfer after the Holder's Death). For the antecedents affidavit that goes with the buyer's own new-licence application, use the Arms Licence Affidavit.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17. Confirm the denomination with the vendor on the day of purchase.

Registration

Not a registrable instrument. It goes to the Licensing Authority with the transfer application and is placed in that office's file. Any sale price paid is a private matter between the parties; this document does not itself transfer title to the weapon. There is no Sub-Registrar step.

Notarisation

Sworn or affirmed before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner appointed for Punjab or for the Union Territory of Chandigarh, who verifies the identity of each person signing and signs, stamps and dates the affidavit before it is filed.

Witnesses

None required by law beyond the notarial attestation; both the Seller and the Buyer sign before the Notary.
