When you need it

For a mason, labourer, carpenter, plumber, electrician, painter or other worker in building and construction work who is registering with the Building and Other Construction Workers Welfare Board for Punjab or for Chandigarh to receive a labour (registration) card and the welfare benefits that go with it — where the application asks for a sworn affidavit of the work done, the days worked and the employer. Filed with the Board's application, usually along with an employer's or contractor's certificate and the worker's identity and address papers.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, non-judicial stamp paper, commonly Rs 10, from SHCIL or the Treasury, Sector 17.

Registration

Not a registrable instrument. Filed with the worker's registration application to the Building and Other Construction Workers Welfare Board of Punjab, or of Chandigarh, through the office or online route the Board names; the Board verifies the work and employer details and may inquire at the site or from the contractor. There is no Sub-Registrar step.

Notarisation

Sworn before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner. Where sworn on the spot at a Sewa Kendra (Punjab) or Sampark centre (Chandigarh), that counter's own attesting officer may accept the affidavit in their presence in place of prior notarisation — confirm with the specific counter first.

Witnesses

None required by law for the affidavit itself; it is authenticated by the notary's or attesting officer's seal alone.
