When you need it

A domestic LPG or piped natural gas connection has to move into a new name — because the person it stood in has died, because the premises it serves have been sold or let to someone else, or because another member of the same household is taking it over — and the distributor (an Indian Oil, HP Gas or Bharat Gas agency, or a piped-gas utility) asks for an affidavit alongside its own transfer form before it re-registers the connection. The distributor's own transfer procedure follows the marketing discipline guidelines its oil marketing company issues, not a statute specific to Punjab or to Chandigarh, so what is jurisdiction-specific here is chiefly where this affidavit is notarised and on what value of stamp paper. Not for: a first application for a new gas connection, which is a different form; or a complaint about a distributor's refusal to transfer, which is taken up with the distributor and, if unresolved, with the oil marketing company's consumer grievance cell.

Stamp duty

An affidavit is chargeable under Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, which Schedule also governs the Union Territory of Chandigarh, and most distributors also ask for an indemnity, which Article 34 of the same Schedule charges at the rate fixed for a security bond. In practice distributors accept this combined affidavit-cum-indemnity on a single non-judicial stamp paper of Rs. 10 to Rs. 100 depending on the distributor's own instruction — ask the distributor which value it wants before buying the stamp paper, since this is set by the distributor's own form rather than by one notified figure. Registration

This affidavit is filed with the distributor for its own record and is not an instrument the Registration Act, 1908 requires to be registered, in Punjab or in Chandigarh. Keep the distributor's acknowledgement of the transfer request.

Notarisation

Distributors in both jurisdictions commonly ask for this affidavit to be notarised before a Notary Public or an Oath Commissioner appointed for Punjab or for the Union Territory of Chandigarh; some accept a self-attested declaration instead for a transfer within the same household — confirm which the particular distributor wants before the appointment.

2.1 I seek transfer of this connection into my name because of the death of the existing consumer, this affidavit being sworn by a legal heir.
