When you need it

Use this when you bought land in Himachal Pradesh with the permission of the Collector under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972, the permission order gave you a time to put the land to the permitted use, and that time is running out or has run out before you could build or start. It is your own application to the Collector asking for more time, giving the reasons and what has been done so far.

Apply before the time in the order ends if you can. A late application is still worth making, but it should say why it is late. The Collector decides whether to extend and on what terms. This paper puts your case; it does not promise an extension. Not for: the first permission to buy (use the Section 118 Permission Application); the sworn papers filed with that application (use the Buyer, Transferor and Co-sharer affidavits in this library).

What follows is written for Himachal Pradesh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This is an application to a government office, so no stamp duty is charged on it. The office may ask for a court-fee stamp or a small fee; no figure could be confirmed here, so ask at the Collector's office before filing.

Registration

Not registrable. It is filed with the Collector, and any order extending the time is an office order, not a registered document.

Notarisation

The application is signed and verified by the applicant. If the Collector's office asks for a supporting affidavit, it is sworn before a notary, an oath commissioner or an executive magistrate.

Witnesses

Not required.

APPLICATION FOR EXTENSION OF TIME UNDER SECTION 118 PERMISSION

To,
The Collector,
Kangra, Himachal Pradesh.

Subject: Application for more time to use land bought under the permission granted under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972.

Respected Sir/Madam,

1. The applicant

1.1 I, Karan Mehta, son of Late Sh. Ramesh Mehta, resident of H.No. 14, Sector 8, Panchkula, Haryana 134109, respectfully state as follows.

2. The permission

2.1 I bought land in Kangra district under permission given by the order Order No. 118/2025/412 dated 10 June 2025 under section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972. The land is:

Mauza Barot, Tehsil Baijnath, Khasra No. 212/1, 0-08-05 hectares

2.2 The permission was given for construction of a dwelling house.

2.3 The time given in the order is: two years from the date of the order, ending on 9 June 2027.

3. What has been done

3.1 The work on the land has not yet been started.

3.2 What has been done so far is:

site plan prepared; building map submitted to the local body on 5 January 2026; boundary wall built

4. Why more time is needed

4.1 The work could not be finished in the time allowed for these reasons:

the building map was approved late, and heavy snow closed the site for most of the winter

4.2 I have not put the land to any use other than the use permitted, and I have not sold, leased or otherwise parted with it.

5. Papers enclosed

5.1 I enclose:

copy of the permission order; copy of the sale deed; copy of jamabandi; photographs of the site; proof of the delay

6. Prayer

6.1 I request that the Collector extend the time for using the land for the permitted use by one year from the date the present time ends, on such terms as the Collector thinks fit, and pass any other order that is needed.
