Subject: Complaint against the Managing Committee of Sunder Nagar Co-operative Housing Society Limited (Registration No. BOM/WK/HSG/(TC)/12345/2003-04), concerning the refusal or unreasonable delay of the Managing Committee in transferring the flat, the shares and the membership.

1. THE COMPLAINANT
1.1 I, Meera Rajan Deshpande, aged about 54 years, residing at X, am a member on the register of the Society, in respect of Flat No. B-704, Sunder Nagar, B Wing in the building of Sunder Nagar Co-operative Housing Society Limited (hereinafter "the Society"), and I make this complaint in that capacity. I reside in the said flat. This complaint is made jointly by me and by X, the joint holder with me in respect of the said flat, who signs it below.
1.2 My status in relation to the Society is evidenced by the records of the Society. My membership number is X. The shares relating to the said flat are covered by Share Certificate No. 118, Distinctive Nos. 586 to 590. I was admitted to membership of the Society on 2 April 2026. The shares and the interest in the capital and property of the Society in respect of the said flat stood in the name of Rajan Vishnu Deshpande, a member of the Society. The said member died on 3 April 2026. My entitlement in respect of the said shares and interest arises under the nomination made by the deceased member in Form No. 14 and recorded by the Society on 8 September 2019, a copy of which is annexed. I am competent to make this complaint in the capacity stated above.

2. THE SOCIETY AND ITS MANAGING COMMITTEE
2.1 The Society is registered under the Maharashtra Co-operative Societies Act, 1960 bearing Registration No. BOM/WK/HSG/(TC)/12345/2003-04, registered on 1 April 2026, and has its registered office at X. The Society is subject to the supervisory jurisdiction of your office.
2.2 The affairs of the Society are managed by its Managing Committee, which holds office as a body of trustees of the funds and records of the Society and is bound to act within the four corners of the Maharashtra Co-operative Societies Act, 1960, the rules made under it, and the registered bye-laws of the Society. Any act of the Committee that is not traceable to a power conferred by the statute, the rules or the bye-laws is without authority.
2.3 The members of the Managing Committee against whose acts and omissions this complaint is directed are:
- Shri A. K. Menon, Chairman
- Smt. P. R. Iyer, Hon. Secretary
- Shri S. D. Kulkarni, Treasurer
All of the above hold office since the general body meeting of 12 August 2024.
The Society, acting through its Managing Committee, is the party against whom relief is sought in this complaint.
3. JURISDICTION AND CHOICE OF FORUM
3.1 This complaint invokes the supervisory and regulatory jurisdiction that the Maharashtra Co-operative Societies Act, 1960 confers on the Registrar over a registered society, its committee, its records, its general body meetings and the application of its funds.
3.2 I am aware that a claim or dispute touching the constitution, management or business of the Society between a member and the Society is not determined in exercise of that supervisory jurisdiction, but is required to be raised before the forum, and in the manner, that the Maharashtra Co-operative Societies Act, 1960 designates for the decision of such disputes, namely a dispute under section 91 of the Maharashtra Co-operative Societies Act, 1960, referred to and decided by the Co-operative Court constituted under that Act.
3.3 This complaint is accordingly confined to relief of a supervisory character, and nothing stated in it is to be read as the reference of a dispute, as an abandonment of any claim that lies before the designated dispute forum, or as an admission on any question of limitation.
4. STATEMENT OF FACTS
4.1 The material facts, stated in numbered paragraphs with their dates, are as follows:
- On 4 March 2025 I applied in writing to the Society for transfer of the flat to my daughter, enclosing the transfer forms, the consent letters and the requisite documents. The Hon. Secretary acknowledged receipt on the same day.
- On 11 April 2025 the Hon. Secretary orally demanded Rs 3,00,000 as 'transfer donation' before the application would be placed before the committee.
- On 20 May 2025 I wrote asking for the committee's decision and for the resolution, if any. No reply was received.
