When you need it

Use this when the original policy bond (the policy document) of a life, health or other insurance policy has been lost, burnt, eaten by termites or otherwise destroyed, and the insurer asks for an indemnity before it issues a duplicate. In the bond you describe the policy, how the original was lost, whether it has been assigned or charged to anyone, and you promise the insurer that you will return the original if it turns up and make good any loss it suffers because it issued the duplicate.

The insurer will also usually want a request for the duplicate, the premium receipts and identity proof; send those with it. Look first for the original and for any copy or electronic version: many insurers can send a copy of the policy by email, and that costs nothing. Report the loss to the police if the insurer asks you to, and keep the report. This is a bond made to one insurer for one policy; it is not a general promise. Check the insurer's own indemnity format, because many have one and will not accept another. Not for a lost vehicle registration certificate or lost motor insurance papers — use the Duplicate RC or Insurance Affidavit. Not a sworn statement of loss on its own. Not a claim — if the policyholder has died, use the Loan Insurance Death Claim Letter for a loan cover, or the insurer's own claim form for a life claim, and attach this bond if the original policy bond cannot be found.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: an indemnity bond is an instrument that carries stamp duty under the Indian Stamp Act, 1899. It is executed on non-judicial stamp paper (an e-stamp paper) of the value the Punjab or Chandigarh stamp rules fix for an indemnity bond. This document does not state the value: confirm the current figure with the insurer and a stamp vendor, and buy the paper in the Indemnifier's own name.

Registration

Punjab and Chandigarh: not registrable. An indemnity for a lost policy bond touches no immovable property, so section 17 of the Registration Act, 1908 does not reach it. Hand it to the insurer against a stamped receipt.

Notarisation

Punjab and Chandigarh: notarisation is not required by law, but many insurers ask for the bond to be notarised or attested before a first-class magistrate or a notary. Ask the insurer what it accepts.

Witnesses

Punjab and Chandigarh: two witnesses sign the bond with their names and addresses, and the Indemnifier signs in their presence.

4.5 The statements in this bond are true to the best of the Indemnifier's knowledge, and the Indemnifier has kept back no fact that the Insurer would reasonably want to know.

4.6 This bond is given for the benefit of the Insurer and its successors, and it binds the heirs and legal representatives of the Indemnifier.
