When you need it

Use this when your insured car, two-wheeler or other vehicle has been stolen and you want your motor insurer to pay its insured value. In one document it gives the claim (the policy, the vehicle, the theft, the FIR and the police position, the keys, where to pay) and the indemnity and undertaking an insurer asks for before it settles a theft claim: you will hand over the original papers and keys, tell the insurer if the vehicle is found, and make good any loss if what you have said is untrue or someone else has a right in the vehicle.

Report the theft to the police and take the FIR first, and tell the insurer at once; a late report is the commonest reason a theft claim is questioned. Most insurers wait until the police close the case with an untraced report before they pay, so expect to produce it. Papers usually asked for: the claim form, FIR, the original registration certificate and keys, the policy, the police untraced report when you have it, the financier's no-objection letter if the vehicle was financed, and a cancelled cheque. Your insurer may also have its own indemnity or subrogation format; give it that if it asks, and use this as your covering claim. Not for damage to a vehicle that is still with you — use the Motor Own-Damage Claim Letter. Not for a vehicle lost with its papers when it was not stolen — see the Duplicate RC or Insurance Affidavit. Not a challenge to a rejected claim — use the Appeal Against Claim Rejection.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: the claim letter in Part A needs no stamp. Part B is a promise to make good a loss; insurers usually ask for it on non-judicial stamp paper (an e-stamp paper) of the value the Punjab or Chandigarh stamp rules fix for an indemnity bond. This document does not state the value: confirm the current figure with the insurer and a stamp vendor, and print Part B on that paper in the owner's own name.

Registration

Punjab and Chandigarh: not registrable. It touches no immovable property, so section 17 of the Registration Act, 1908 does not reach it. Keep proof of the day it was lodged.

Notarisation

Punjab and Chandigarh: the insurer may ask for Part B to be notarised or sworn before it settles. Ask which of its papers it wants notarised.

Witnesses

Punjab and Chandigarh: two witnesses sign Part B, because insurers commonly require them. The claim letter in Part A needs none.

3.1 Please register this claim, give me the claim number in writing, and tell me in one list every paper you still need, with the name and number of the officer handling the claim.

3.2 Please settle the claim for the insured value of the vehicle, less only what the policy allows, and give me each deduction in writing with the clause of the policy you rely on.

3.3 Please pay the amount due by transfer to the account held by Harjinder Singh Gill with HDFC Bank, Sector 40, Chandigarh, account ending 3391. I will give the full account number on your own form, not in this letter.

4. WHAT I PROMISE

4.1 In return for your settling this claim, I, Harjinder Singh Gill, promise and agree as follows.

4.2 I will hand over to you the original registration certificate, the original keys and such other papers and things as you reasonably ask for, and will sign any letter of transfer or subrogation needed to pass the vehicle to you once the claim is settled.

4.3 If the vehicle is found, before or after the claim is paid, I will tell you at once. If it is found after payment, I will give it to you, or, if you choose, take it back and repay the amount you paid me for it.

4.4 I have not sold, pledged or parted with the vehicle, and no other insurer has been or will be asked to pay for the same loss.
