Why you need it

When you need it

Subletting needs landlord consent — unlike a guest, it's a secondary occupation. Name the sub-tenant, portion, dates, sub-rent and the tenant's liability; no direct landlord-subtenant relationship arises from consent alone. Unauthorised subletting risks serious rent-law consequences.

See stamp duty, registration and witnesses

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Depends on effect — mere consent isn't the sublease; a separate sublease is stamped on its own term and consideration.

Registration

Not registrable as consent. A s.17(1)(d) sublease needs registering within 4 months (s.23), subject to s.25.

Notarisation

No substitute for registration; consent needs none.

Witnesses

Both sign; witnesses help, though irrelevant to registration.
