When you need it

Use this when a student is renting a room or flat near a college or university in Punjab or Chandigarh and the landlord wants a parent or guardian to stand behind the rent. It is one document that signs up the landlord, the student and the guarantor: the student rents the home, and the guarantor promises to pay if the student does not pay the rent, the bills or the cost of damage during the term.

A person under eighteen cannot make a binding rent agreement. If the student is under eighteen, the parent or guardian should be the tenant and sign as tenant, and the student should be named only as the person who will live there; use the Residential Rent Agreement, 11 Months in that case. This document has the student confirm that they are an adult. The guarantee is limited to this agreement's term and to what the student owes under it. The guarantor does not become a tenant and has no right to live in the home. A change in the terms that the guarantor has not agreed to in writing can release the guarantor, so any change should be signed by all three. Punjab runs two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of the letting; this document does not say which governs the tenancy. Not for: a bed or room in a paying-guest house (use the Paying Guest Agreement); a guarantee added to an existing tenancy (use the Guarantor Agreement for a Tenancy); flatmates sharing one rent (use the Joint Tenancy Agreement for Flatmates).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty depends on the rent, the term and the deposit, and Punjab and Chandigarh charge differently. As published by the two Revenue Departments and read on 6 September 2026: Punjab charges 4% of the annual rent on a lease of less than one year; Chandigarh has no separate slab for that and charges, in its row for a term up to five years, 2% of the annual average rent plus 3% of the refundable security deposit. Neither table is dated, so confirm the figure on the official e-stamping portal or with the Sub-Registrar before you buy the stamp. If the paper is in substance a lease, the lease rate applies whatever it is called. An under-stamped paper cannot be used as evidence until the deficit and penalty are paid.

Registration

Registration is not compulsory for a term of less than one year with the rent reserved monthly (section 17(1)(d), Registration Act, 1908), which is why such papers are kept short. A Punjab tenancy that falls under the Punjab Rent Act, 1995 may need a written, registered agreement in the form that Act prescribes; check this before relying on a short unregistered paper. If you do register, present the document to the Sub-Registrar within four months of signing.

Notarisation

Not required by law, and not a substitute for stamping or registration. A notary only records that the signatories appeared and signed, which makes it harder to deny a signature later. Carry original photo ID.

Witnesses

Two witnesses are sensible: for a registered document both parties come to the Sub-Registrar with two identifying witnesses who carry original photo ID. Each witness writes full name, address and ID reference beside the signature. A witness is an adult who is not a party to the document.

STUDENT RENT AGREEMENT WITH PARENT AS GUARANTOR

This Agreement is made at Chandigarh on 1 April 2026.

BETWEEN

Harpreet Singh, of House No. 45, Sector 21-C, Chandigarh (the "Landlord");

Simran Kaur, of Village Dhandra, Tehsil Ludhiana East, Punjab, a student of B.Tech, Punjab Engineering College, Chandigarh, who has shown college ID card, number ending 4521 (the "Student");

AND

Gurdev Singh, the Student’s father, of Village Dhandra, Tehsil Ludhiana East, Punjab, phone +91 98765 43210 (the "Guarantor").

1. The tenancy

1.1 The Landlord lets to the Student a flat at Flat 804, Maya Garden City, Zirakpur, Punjab (the "Home") for residence only, for the Student alone, for the term in clause 2.
1.2 The Student confirms that the Student is eighteen years of age or older.

2. Term

2.1 The tenancy begins on 2 April 2026 and ends on 1 March 2027, unless it ends earlier under clause 7. It does not renew by itself or by the Student staying on; a further tenancy needs a fresh written agreement that the Guarantor also signs.

3. Rent

3.1 The Student pays the Landlord rent of ₹9,000 (Rupees Nine Thousand only) a month, in advance, by day 5 of each month, by bank transfer or cheque, against a written receipt.
3.2 Rent is payable for every month of the term, including holidays and vacations. The Student also pays the electricity, water, gas and internet bills for the Home, unless the Parties agree otherwise in writing.

4. Security deposit

4.1 The Student has paid the Landlord ₹18,000 (Rupees Eighteen Thousand only) as a refundable security deposit, which carries no interest. The Landlord returns it within 15 days after the Student hands back the Home, less only unpaid rent, unpaid bills and the cost of repairing damage beyond ordinary wear, and shows the figures to the Student and the Guarantor.

5. The Student’s duties

5.1 The Student uses the Home only as a residence, keeps it clean and in good condition, follows the rules of the building and society, and causes no nuisance to neighbours.
5.2 Only the Student may live in the Home. The Student may not sub-let or share it, may not keep paying guests, and may have overnight visitors only with the Landlord’s permission. The Student makes no structural change without the Landlord’s written consent.
5.3 The Landlord carries out structural and major repairs. The Student carries out minor day-to-day repairs and pays for damage caused by the Student or the Student’s visitors.
5.4 The Landlord may enter the Home to inspect it or to carry out repairs at reasonable hours on twenty-four hours’ notice, and at any time in an emergency. The Student gives the Landlord the identity details the local police station asks for, and the Landlord gives them to the police as the local rules require.
