When you need it

Use this when you let a single room, a barsati (a room on the roof), an annexe or one portion of a house to a tenant, and the rest of the building stays with you or with other occupants. It is a rent agreement for a part of a building: it describes exactly which part is let, which areas are shared (the stairs, the water tank, the courtyard, the gate), how electricity and water are charged, and how far you may enter.

It differs from the Residential Rent Agreement, 11 Months, which is written for a whole flat or house, and from the Paying Guest Agreement, which includes food or services. It differs from the Residential Leave and Licence Agreement because the tenant here pays rent for a defined portion in their own right. Punjab runs two rent laws, the Punjab Rent Act, 1995 and the East Punjab Urban Rent Restriction Act, 1949, split by the date of the letting and the kind of building. Whether either reaches a single room in a house where the owner also lives, and what it says about such a letting, is for a lawyer to confirm. This document does not state which applies. Not for: a whole flat or house (use the Residential Rent Agreement, 11 Months); a bed in a shared room (use the Bed Space Licence Agreement); a shop or office.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty depends on the rent, the term and the deposit, and Punjab and Chandigarh charge differently. As published by the two Revenue Departments and read on 6 September 2026: Punjab charges 4% of the annual rent on a lease of less than one year; Chandigarh has no separate slab for that and charges, in its row for a term up to five years, 2% of the annual average rent plus 3% of the refundable security deposit. Neither table is dated, so confirm the figure on the official e-stamping portal or with the Sub-Registrar before you buy the stamp. If the paper is in substance a lease, the lease rate applies whatever it is called. An under-stamped paper cannot be used as evidence until the deficit and penalty are paid.

Registration

Registration is not compulsory for a term of less than one year with the rent reserved monthly (section 17(1)(d), Registration Act, 1908), which is why such papers are kept short. A Punjab tenancy that falls under the Punjab Rent Act, 1995 may need a written, registered agreement in the form that Act prescribes; check this before relying on a short unregistered paper. If you do register, present the document to the Sub-Registrar within four months of signing.

Notarisation

Not required by law, and not a substitute for stamping or registration. A notary only records that the signatories appeared and signed, which makes it harder to deny a signature later. Carry original photo ID.

Witnesses

Two witnesses are sensible: for a registered document both parties come to the Sub-Registrar with two identifying witnesses who carry original photo ID. Each witness writes full name, address and ID reference beside the signature. A witness is an adult who is not a party to the document.

ROOM OR PORTION RENT AGREEMENT

This Agreement is made at Chandigarh on 1 April 2026.

BETWEEN

Harpreet Singh, of House No. 45, Sector 21-C, Chandigarh (the "Landlord");

AND

Aarav Sharma, of Village Bahadurgarh, Tehsil Patiala, Punjab, who has shown driving licence, number ending 4521 (the "Tenant").

1. The portion let

1.1 The Landlord lets to the Tenant a single room in the building at Flat 804, Maya Garden City, Zirakpur, Punjab, described as the first-floor room on the east side with an attached bathroom and a separate staircase (the "Portion"), for residence only, for the Tenant and his wife and one child.
1.2 The Tenant may also use these shared areas with the Landlord and the other occupants: the main gate, the courtyard, the water tank and the terrace for drying clothes. Everyone using them keeps them clean and does not block them.
1.3 The rest of the building stays with the Landlord or the other occupants, and the Tenant has no right in it.

2. Term

2.1 The tenancy begins on 2 April 2026 and ends on 1 March 2027, unless it ends earlier under clause 8.
2.2 It does not renew by itself or by the Tenant staying on. A further tenancy needs a fresh written agreement.

3. Rent

3.1 The Tenant pays the Landlord rent of ₹8,000 (Rupees Eight Thousand only) a month, in advance, by day 5 of each month, by bank transfer or cheque, against a written receipt.
3.2 Electricity: A separate meter serves the portion and the Tenant pays its bill. Water and other shared charges are as the Parties agree in writing.

4. Security deposit

4.1 The Tenant has paid the Landlord ₹16,000 (Rupees Sixteen Thousand only) as a refundable security deposit, which carries no interest.
4.2 The Landlord returns it within 15 days after the Tenant hands back the Portion, less only unpaid rent, unpaid bills and the cost of repairing damage beyond ordinary wear, and shows the Tenant the figures.

5. Use

5.1 The Tenant uses the Portion only as a residence, keeps it clean and in good condition, and follows the rules of the building and of the society or association, if any.
5.2 The Tenant may not sub-let, share or transfer the Portion, carry on a business there, cause nuisance to the Landlord or neighbours, or do anything unlawful, and makes no structural change without the Landlord’s written consent.
5.3 The Landlord carries out structural and major repairs. The Tenant carries out minor day-to-day repairs, and pays for damage caused by the Tenant or those staying with the Tenant.

6. Landlord’s entry

6.1 The Landlord may enter the Portion to inspect it or to carry out repairs at reasonable hours on twenty-four hours’ notice, and at any time in an emergency. Otherwise the Landlord respects the Tenant’s privacy in the Portion.
