When you need it

A visa officer for a visit or a short stay has to be satisfied that you will return, and looks for ties that bring you back: your family, your job or business, and your property in India. This is your signed declaration setting out each of those, with the papers that show them.

It is a statement you make, not a sworn affidavit; where an office asks for an affidavit, use the same facts in one. Not for: a letter of leave from your employer (use the Employer NOC / Leave Letter for Visa), a statement of who is in your family for a family-class application (use the Relationship Affidavit for Visa), or the cover letter that accompanies the whole file (use the Tourist Visa Cover Letter).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Not a stamp-dutiable instrument when made as a signed declaration on plain paper. If an office asks for it as an affidavit, the affidavit position applies: a nominal fixed duty, commonly printed as Rs 25 — confirm at the counter.

Registration

Not registrable.

Notarisation

Not legally required for a plain declaration. Some offices ask for it to be notarised or sworn as an affidavit; confirm what the checklist says.

Witnesses

Not required.
