When you need it

Use this when a company, hatchery or integrator and a farmer agree that the company will place day-old chicks in the farmer's poultry shed and supply the feed, medicine and technical advice, the farmer will rear the birds with his shed, labour, water and electricity, and the company will lift the grown birds and pay the farmer a growing charge. It records the shed and the number of birds, what each side supplies, the growing charge and how it is worked out, the performance norms, who bears the loss from disease or death of birds, payment, lifting, and how the contract ends.

The birds, feed and medicine stay the company's property throughout; the farmer is a grower and not a buyer of the birds, and the company gets no interest in the farmer's land or shed. Not for: contract farming of a field crop (use the Contract Farming Agreement); the farmer buying chicks and selling birds on his own account.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is charged on this agreement as a conveyance or a lease, because it transfers no land or other immovable property. A general agreement may attract a fixed duty under the residual agreement entry of the Punjab or Chandigarh schedule, and this drafter could not confirm one current figure, so none is stated. Before signing, ask on the official e-stamping portal or at the Sub-Registrar counter whether any duty applies, and use stamp paper of the value named. An under-stamped paper cannot be used as evidence until the deficit and penalty are paid.

Registration

Not compulsorily registrable: this agreement creates no interest in immovable property, so section 17 of the Registration Act, 1908 does not require it to be registered. The parties may still choose to register it for extra evidential weight.

Notarisation

Not required. Either party may have it notarised for extra comfort that the signatures are genuine; carry original photo ID.

Witnesses

Not required by law, but two adult witnesses who are not parties are customary in village practice and are provided for below.
