When you need it

Use this when a property broker works with a freelance associate or sub-broker who brings in clients and properties for a share of the brokerage. It makes clear that the associate is paid out of brokerage the broker actually receives, within a fixed number of days; that the associate is not an employee and cannot sign for the broker or take a token; and that the associate must not bypass the broker on a deal the broker introduced.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty is charged on an agreement of this kind under the Indian Stamp Act, 1899 as it applies in Punjab and Chandigarh. It creates no interest in property, so it is not stamped as a deed of sale or lease; confirm the article and amount at the e-stamp counter and stamp it before signing.

Registration

Not registrable as a matter of course: it creates no right of ownership or lease in the project. Registration is optional.

Notarisation

Not required.

Witnesses

Two witnesses are recommended; they help prove signing.

SUB-BROKER OR ASSOCIATE AGREEMENT

How a broker works with an associate who brings in deals for a share of the brokerage

Executed at Mohali on 1 April 2026.

Parties

1. The Principal Broker — Rajinder Kumar Bansal, trading as Bansal Property Consultants, of SCO 22, Phase 3B2, SAS Nagar (Mohali), Punjab 160059, mobile 98765 43210, email name@example.com, real estate agent registration number PBRERA-SAS80-REA0123 ("the Principal Broker").

2. The Associate — Amandeep Kaur Sidhu, of House No. 88, Sector 68, SAS Nagar (Mohali), Punjab 160062, mobile 98765 43210, email name@example.com, registration number X ("the Associate").

1. The arrangement

1.1 The Principal Broker engages the Associate to find clients and properties for the Principal Broker's business, in resale and rental of residential property in Mohali and Zirakpur.

1.2 The Associate works for a share of brokerage and not for a salary. The Associate is not the Principal Broker's employee, and may choose when and how to work, within the Principal Broker's reasonable instructions about a particular client.

1.3 The Associate has no authority to sign for the Principal Broker, to bind it, to take a booking amount or token, or to make a promise to any client in its name. All money for a transaction goes to the owner or the builder named in the transaction papers, never to the Associate.

2. The share

2.1 On a transaction that the Associate brought in and that the Principal Broker concludes, the Associate is entitled to 50 per cent of the brokerage the Principal Broker receives ("the Share").

2.2 The Share is payable only out of brokerage the Principal Broker has actually received. The Principal Broker will pay the Share within 7 days of receiving the brokerage, with a short statement of what was received and from whom.

2.3 Where the Principal Broker's client does not pay, the Principal Broker will take reasonable steps to recover the brokerage and will tell the Associate. The Associate may not claim the Share from the client, only from the Principal Broker, and only after the Principal Broker is paid.

2.4 A transaction counts as the Associate's if the Associate first introduced the client or the property to the Principal Broker in writing, including by message, and the Principal Broker accepted it.

3. Conduct and compliance

3.1 The Associate will give clients true information, will not exaggerate a property or promise a price, and will use only material the Principal Broker has approved.

3.2 Where a project is registered with a Real Estate Regulatory Authority, the Associate will not deal in it unless the law permits the Associate to do so under the Principal Broker's registration or the Associate's own.

3.3 Each of them is responsible for the tax on what that person receives.
