When you need it

Use this when a builder or developer takes on an agent as a channel partner to market one registered project and bring buyers, and you want the terms written down: which units, the commission and when it is paid, how a lead is registered and protected, what happens to commission if a booking is cancelled, and that buyers pay the builder directly, never the agent. Not the Agent Registration and KYC Form, which only records the agent's identity before this stage.

Not a leasing mandate or a brokerage agreement with an owner. Not a sub-broker agreement, which is between an agent and the agent's own associate. Read before signing: the agent must hold a valid real estate agent registration to deal in a registered project, and the builder's project must be registered. GST on commission depends on the agent's own registration; ask your tax adviser.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty is charged on an agreement of this kind under the Indian Stamp Act, 1899 as it applies in Punjab and Chandigarh. It creates no interest in property, so it is not stamped as a deed of sale or lease; confirm the article and amount at the e-stamp counter and stamp it before signing.

Registration

Not registrable as a matter of course: it creates no right of ownership or lease in the project. Registration is optional.

Notarisation

Not required.

CHANNEL PARTNER AGREEMENT WITH A BUILDER

How a builder appoints a registered real estate agent to market and refer buyers for one project

Executed at Mohali on 1 April 2026.

Parties

1. The Builder — Shivalik Homes Private Limited, whose registered office is at SCO 100, Sector 9, Chandigarh 160009, acting through Mr Harvinder Singh, Director ("the Builder").

2. The Channel Partner — Rajinder Kumar Bansal, trading as Bansal Property Consultants, of SCO 22, Phase 3B2, SAS Nagar (Mohali), Punjab 160059, mobile 98765 43210, email name@example.com, real estate agent registration number PBRERA-SAS80-REA0123 ("the Channel Partner").

Background

A. The Builder is developing the project Shivalik Greens at Sector 82, SAS Nagar (Mohali), Punjab, in Punjab, registered under the real estate regulatory law with registration number PBRERA-SAS80-PR0123 ("the Project").

B. The Builder wishes the Channel Partner to market the Project and to bring prospective buyers, and the Channel Partner agrees, on the terms below.

1. Appointment

1.1 The Builder appoints the Channel Partner, on a non-exclusive basis, to market All 3 BHK flats in Towers A and B in the Project ("the Units") and to introduce prospective buyers.

1.2 The Builder may appoint other channel partners and may sell directly. A sale the Channel Partner did not introduce earns it no commission.

2. Registration and compliance

2.1 The Channel Partner states that its registration as a real estate agent is valid, and will keep it valid for the whole term. It will tell the Builder at once if the registration lapses or is refused, suspended or revoked, and until it is restored the Channel Partner will do nothing under this agreement.

2.2 The Builder states that the Project is registered and will keep the registration valid, and will give the Channel Partner the approved brochures, price lists and project information.

2.3 The Channel Partner will describe the Project only as the approved material and the registered particulars describe it, will make no promise about price, possession, returns or amenities that the Builder has not approved in writing, and will use no unfair trade practice.

2.4 The Channel Partner will not take any money for the Project in its own name or on the Builder's behalf. A buyer pays the Builder directly, into the account the Builder names, and the Channel Partner will say so to every buyer.

3. Registering a lead

3.1 The Channel Partner registers a prospective buyer by sending the Builder the buyer's name and contact details in writing, with the buyer's knowledge and agreement that the details may be shared.

3.2 If the Builder accepts the lead, it is credited to the Channel Partner for 90 days from acceptance. If the Builder does not accept or reject it within seven days, the Channel Partner may ask in writing, and the Builder will answer.
