When you need it

Use this when you believe a doctor or hospital treated you or a family member without proper care, with a wrong diagnosis, wrong medicine, a botched operation, a missed complication or a failure to act, and harm or death followed. It is a written complaint to the hospital management and, if you choose, to the State Medical Council or health authority, asking for an inquiry, for the records, and for action; it states facts and does not accuse beyond what you know.

First ask the hospital in writing for a complete copy of the treatment records, bills and test reports, since a hospital is bound to supply them. Strong complaints rest on an independent medical opinion; it helps to get one before any court filing, and courts and the police usually look for one. Gather the records and bills and note the dates. Never write a medical-card number or other identifier you do not need. If the complaint is not acted on, the matter can go to the District Consumer Commission or, where there is a death or serious injury, to the police, usually through an advocate. Not for an insurance claim: see the insurance complaint documents.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A letter of complaint creates, transfers or extinguishes no right, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and you sign it alone.

Registration

Punjab and Chandigarh: not registrable. This letter creates or transfers no right in immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it. Keep the proof of sending, the acknowledgement and the treatment records you receive.

Notarisation

Punjab and Chandigarh: no notarisation is needed. The letter works because it is in writing, dated and reaches the other side, not because anyone attests your signature.

Witnesses

Punjab and Chandigarh: no witness is needed. You sign alone.

MEDICAL NEGLIGENCE COMPLAINT

Complaint about treatment believed to have been careless, with a request for an inquiry

Date: 1 April 2026, at Ludhiana

I am sending this by registered post with acknowledgement due. I am also emailing a copy to ms@citycare.example.com.

To: The Medical Superintendent, City Care Hospital, Jalandhar, GT Road, Jalandhar 144001

From: Gurpreet Singh Dhillon, House No. 88, Urban Estate Phase 2, Patiala 147002 (email gurpreet.dhillon@example.com, telephone +91 98150 47731)

Subject: Complaint about the surgery on Mrs Kamla Devi on 4 October 2026 at City Care Hospital

Sir or Madam,

  1. 1. The patient. The patient is Mrs Kamla Devi. I am her son, who was with her throughout. The treatment was by Dr R. K. Verma, surgeon, City Care Hospital, Jalandhar.
  1. 2. The treatment. She was admitted on 3 October 2026 with abdominal pain and, after a scan, operated on for gallstones on 4 October 2026. She was discharged on 6 October 2026.
  1. 3. What I say went wrong. Within a day she developed fever and severe pain. We told the staff, who gave painkillers and did not call the surgeon. On 8 October 2026 another hospital found a bile leak and an instrument-related injury and operated again. I state these as facts known to me and I do not claim to give a medical conclusion.
  1. 4. The result. A second operation, nineteen further days in hospital, and a long recovery. She is still unable to work. The bills I can show come to ₹4,12,000 (Rupees Four Lakh Twelve Thousand only).
  1. 5. Other opinion. The surgeon at the second hospital wrote a discharge summary describing the bile leak and the repair done. I have not yet obtained a separate expert opinion.
  1. 6. What I have already done. I raised it with the ward nurse on 5 October 2026 and with the hospital manager on 12 October 2026. I asked for the records on 15 October 2026 and have received only the discharge slip.
  1. 7. What I ask. An inquiry by a committee of senior doctors, the complete records, a written explanation, appropriate action, and compensation for the harm and expense. Please also give me, within the time the law allows, complete certified copies of the treatment records, charts, consent forms, test reports and bills, and tell me in writing the name of the officer handling this complaint.
  1. 8. Keep the records. Please keep all records, films, charts and logs of this treatment safe and do not alter or destroy them.
  1. 9. My other rights. This complaint is without prejudice to my right to take the matter to the District Consumer Commission, to complain to the medical council, and to report to the police if the facts warrant it. This letter does not waive any of my rights.

ENCLOSURES

  1. 1. Discharge slips of both hospitals. 2. Bills and receipts. 3. Reports of the scans. 4. My written request for the records dated 15 October 2026.
