When you need it

Use this when a car dealer sold you a car that is faulty or not as promised, delayed delivery, refused to honour the warranty, or when a service centre did poor work, charged for work not done, or kept your car too long. It is a firm first complaint to the dealer or service centre, with a copy to the manufacturer's customer care, giving a fixed time to put things right.

Answer from your invoice, job card, warranty booklet and messages; note the date of each visit and what was said. Never write a bank or card number. Send the signed letter by registered post or courier and email, and keep the proof. If nothing is done, send the Notice for Faulty Product or Deficient Service for a formal last chance, then file the Consumer Complaint to the District Commission. Not for the sale or transfer between two private owners: use the Car or Bike Sale Agreement. Not for a loan on the car: that is a matter with the lender.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A letter of complaint creates, transfers or extinguishes no right, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and you sign it alone.

Registration

Punjab and Chandigarh: not registrable. This letter creates or transfers no right in immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it. Keep the proof of sending, the job card and the dealer's reply.

Notarisation

Punjab and Chandigarh: no notarisation is needed. The letter works because it is in writing, dated and reaches the other side, not because anyone attests your signature.

Witnesses

Punjab and Chandigarh: no witness is needed. You sign alone.

COMPLAINT AGAINST A CAR DEALER OR SERVICE CENTRE

Complaint about a car sale or service, with a request to put it right

Date: 1 April 2026, at Ludhiana

I am sending this by registered post with acknowledgement due. I am also emailing a copy to gm@sunrisemotors.example.com.

To: The General Manager, Sunrise Motors (authorised dealer), Plot 15, Industrial Area Phase 1, Mohali 160055; with a copy to Customer Care, Example Motors India Ltd, Gurugram

From: Gurpreet Singh Dhillon, House No. 88, Urban Estate Phase 2, Patiala 147002 (email gurpreet.dhillon@example.com, telephone +91 98150 47731)

Subject: Repeated gearbox failure in new car PB 65 AB 1234, invoice SM/2026/0871

Sir or Madam,

  1. 1. My car. The car is an Example Motors Zeta petrol, registration PB 65 AB 1234. I bought the car from you as a new car. The invoice or job card is invoice SM/2026/0871 dated 14 August 2026, and I paid ₹8,65,000 (Rupees Eight Lakh Sixty Five Thousand only).
  1. 2. What is wrong. The gearbox jerked and stalled from the first month. It was taken to your service centre on 12 September, 3 October and 28 October 2026. Each time it was returned as "checked", and the fault came back within days.
  1. 3. What was promised. The warranty booklet gives a two-year or 40,000 km warranty on the gearbox, and the salesperson assured me the car was in perfect order.
  1. 4. Why I complain. A car sold with a fault, a warranty not honoured, or a repair that is not done properly or is charged for and not done, is a defect in goods or a deficiency in service. I have given you repeated chances to put it right.
  1. 5. What I require. Within fifteen days of receiving this complaint, repair the fault properly, free of charge under the warranty, and give me a written guarantee for the repair. I also ask you to pay ₹25,000 (Rupees Twenty Five Thousand only) as compensation for my loss and trouble.
  1. 6. If you do not. If this is not done within fifteen days, I will send a formal notice and file a consumer complaint before the District Consumer Commission, and I will ask for refund or replacement, compensation, interest and costs. I ask you to keep the car's service records and messages safe. This letter does not waive any of my rights.

ENCLOSURES

  1. 1. Invoice SM/2026/0871. 2. Warranty booklet pages. 3. Job cards of 12 September, 3 October and 28 October 2026. 4. Photographs and messages showing the fault.
