When you need it

The heirs' claim for a Public Provident Fund account, a post office account or a National Savings Certificate when the holder has died and left no nominee. The claim letter goes to the post office, or to the bank branch that keeps the PPF account.

If you choose, the affidavit and the indemnity that such an office commonly asks for are added behind the letter, so that you hand over one set of papers. You list the accounts and certificates (one office per letter: write again for another office), say whether there was a nominee, say whether you are the only legal heir, or claim for yourself and the others who have agreed in writing, or hold a court certificate. If you add the affidavit and indemnity, you also name the person before whom the affidavit is sworn and two witnesses to the indemnity. Papers to attach: the death certificate; the passbook, certificates or the account statement; your identity and address proofs with the Aadhaar number masked; the office's claim form; and the proof of heirship it accepts. The papers an office asks for, and the amount above which it wants a court certificate, are set by its own rules: ask before you go. Not for a bank fixed deposit (use the Fixed Deposit Claim Letter) or for an indemnity to a bank on its own form (use the Indemnity Bond for Deceased's Bank Claim). To prove who the heirs are, see the Affidavit That There Is No Other Legal Heir.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: the claim letter needs no stamp duty, because it creates, transfers or extinguishes no right and is not an instrument within section 2(14) of the Indian Stamp Act, 1899. If you add the affidavit and the indemnity, each is a separate paper that goes on stamp paper of the value the office specifies or the stamp rules for an affidavit and for an indemnity require. This library does not state a figure for either: confirm with the post office or bank and the stamp vendor before you buy the stamp paper.

Registration

Punjab and Chandigarh: not registrable. A PPF balance, a post office account and a savings certificate are money, not immovable property, so section 17 of the Registration Act, 1908 does not reach the letter, the affidavit or the indemnity. Keep a copy of each and the office's acknowledgement.

Notarisation

Punjab and Chandigarh: the letter needs no notarisation. The affidavit is sworn before the notary or oath-taking authority the office accepts, and the indemnity is signed in front of its two witnesses; some offices want a notary or an officer of their own to verify the signatures. Ask the office what it accepts.

Witnesses

Punjab and Chandigarh: the letter needs no witness. The indemnity, if added, is signed in the presence of the two witnesses named in it; the office may also want to know them or to see their identity proofs.

Sir or Madam,

  1. 1. The accounts and certificates. Harpreet Singh held the following with you: PPF account 1234567890; National Savings Certificates nos. 11A 123456 to 11A 123460.
  1. 2. The death. Harpreet Singh died on 1 April 2026 at Chandigarh. The death certificate is DTH/2026/118, and a copy is enclosed. Please record the death against each account and certificate from that date.
  1. 3. The nominee. No nominee is recorded for the accounts and certificates.
  1. 4. My right to claim. My relationship to the holder: Spouse. I am the only legal heir known to me.
  1. 5. The legal heirs. Apart from me, the other legal heirs of Harpreet Singh are: Naina Singh and Meera Singh, Chandigarh.
  1. 6. What I ask you to do.

(a) Mark each account and certificate as that of a holder who has died, and do not pay any other person from today.

(b) Tell me in writing the claim form and every paper you need from me and from the other legal heirs, and whether you will settle on the papers I name or ask for a court certificate.

(c) Tell me the amount payable on the date of death and the amount payable today, with the interest worked out at each date, the rate on which you have worked it, and any rule that stops or changes the interest after the death.

(d) Pay the amount due to the account described in paragraph 7.

(e) Give me a statement of the interest paid, in the form you issue to holders.

  1. 7. Where to pay. Please pay the amount to the account held by Aarav Singh with State Bank of India, Sector 35, Chandigarh, account ending 4821. I will give the full account number on your own form and not in this letter.
  1. 8. What I accept. I understand that you will pay so that you are safely discharged, and that this does not by itself decide who owns the money as against the other legal heirs. If you pay and it is later found that someone else had a better right, I will account to that person for what I received.
  1. 9. If the claim is not settled. If you reject the claim or do not reply within the time allowed, I will take the matter to the senior officer of your office, and I am free to bring a consumer complaint before the District Consumer Disputes Redressal Commission.
  1. 10. The affidavit and the indemnity. The affidavit and the indemnity, signed by me, are given with this letter and set out below.

Please acknowledge this letter and tell me the name and telephone number of the officer who will handle the claim.
