When you need it

A request to move the shares and mutual fund units of a person who has died into the name of the nominee or the legal heirs. You choose whether the investments sit in a demat account or are held in physical form or in a folio, and the request goes to the depository participant, or to the company's registrar or the fund house, as the case may be.

It lists what the person held, says on what basis you ask, and asks for a statement of the holdings as on the date of death. Papers to attach: the death certificate; your identity and address proofs with the Aadhaar number masked, and a copy of the cancelled cheque or a bank proof; the person's demat statement or folio statement if you have it; and the proof of your right (nominee, or heirship papers, a succession certificate or an indemnity where there is no nominee). Each institution has its own transmission form and checklist: ask for it before you send this letter, and ask what is needed if you do not yet have a demat account in your own name. No stamp duty or registration is needed for the letter. Not for the shares of a co-operative housing society (use Transmission of Shares on Death). If the other legal heirs agree that the holding goes to one of them, they give a No Objection by Other Heirs to a Transmission. To prove who the heirs are, see the Affidavit That There Is No Other Legal Heir.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A request to an investment institution to record a death and transmit a holding creates, transfers or extinguishes no right in itself, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and the claimant signs it alone. The institution may separately ask for an indemnity or an affidavit on stamp paper; those are other papers, and their duty is not part of this letter.

Registration

Punjab and Chandigarh: not registrable. Shares and mutual fund units are movable property, so section 17 of the Registration Act, 1908 does not reach this letter. Keep a copy and the institution's acknowledgement.

Notarisation

Punjab and Chandigarh: no notarisation is needed for the letter. The institution's transmission form may ask for signatures to be attested by a bank manager or another officer, and an affidavit or indemnity may need to be sworn; follow what the form says.

Witnesses

Punjab and Chandigarh: no witness is needed for the letter. The claimant signs alone; any witness or attestation on the institution's own form is its requirement.

SHARES AND MUTUAL FUNDS TRANSMISSION REQUEST

Request to record a death and transmit shares and mutual fund units

Date: 2 April 2026, at Chandigarh

To: The Officer in charge of transmission, XYZ Securities Ltd (depository participant), Sector 17, Chandigarh

From: Aarav Singh, Sector 35, Chandigarh. Telephone: +91 XXXXX XXXXX. Email: aarav@example.com.

Subject: Death of Harpreet Singh — request to transmit the shares and mutual fund units

Sir or Madam,

  1. 1. The holding. Harpreet Singh held the investments described in this letter. The investments are held in a demat account with a depository participant. The holding was in the sole name of the person who died. The demat account: XYZ Securities Ltd, DP ID IN300000, client ID 12345678
  1. 2. The investments. 200 shares of XYZ Ltd; units of ABC Equity Fund (growth).
  1. 3. The death. Harpreet Singh died on 1 April 2026 at Chandigarh. The death certificate is DTH/2026/118, and a copy is enclosed. Please record the death against the holding from that date.
  1. 4. My right to ask. My relationship to the person who died: Spouse. I am the nominee recorded for the holding. I ask that the investments be placed in the name of Aarav Singh.
  1. 5. The legal heirs. Apart from me, the other legal heirs of Harpreet Singh are: Naina Singh and Meera Singh, Chandigarh.
  1. 6. What I ask you to do.

(a) Record the death against the holding, and do not act on any instruction about it from anyone else until the transmission is decided.

(b) Tell me in writing the transmission form and every paper you need from me and from the other legal heirs, and whether you need anything more because of the value of the holding or because I do not yet have a demat account or folio of my own.

(c) Keep the investments as they are and move them into the name of the person named in paragraph 4.

(d) Give me a statement of the investments, with the number of shares or units and their value as on the date of death and as on today.

(e) Confirm to me in writing when the transmission is done, and send me the new statement.

  1. 7. What I accept. I understand that a nominee is dealt with so that you are safely discharged, and that this does not by itself decide who owns the investments as against the other legal heirs. If the investments are placed in my name and it is later found that someone else had a better right, I will account to that person for what I received.
  1. 8. If the request is not dealt with. If you reject the request or do not reply within the time allowed, I will write to your investor grievance officer and then use the complaint route open to investors, including the complaint system of the Securities and Exchange Board of India, and I am free to bring a consumer complaint before the District Consumer Disputes Redressal Commission.
