When you need it

You are hiring one tradesman or small firm for one trade at your house or flat — electrical, plumbing and sanitary, tile and flooring, or painting — and want the scope, the rate, who buys the materials, the payment and the time written down before work begins. Not for the whole house build — use the House Construction Contract.

Not for interiors with carpentry and false ceilings together — use the Interior Work Contract. Not for labour only through a thekedar — use the Labour-only Contract (Thekedar Agreement). For extra or changed work after this order is signed, use the Variation Order and Extension of Time.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable as an agreement, not a conveyance — it transfers no interest in the Site. PUNJAB: Article 5, Schedule I-A to the Indian Stamp Act, 1899 as applicable in Punjab; confirm the current figure with the Sub-Registrar or against the Department of Revenue, Rehabilitation and Disaster Management's published table at revenue.punjab.gov.in before the stamp is bought. CHANDIGARH: the equivalent agreement article under the Chandigarh Administration's Rates of Stamp Duty & Registration Fees table at revenue.chd.gov.in; confirm the current figure at the Sub-Registrar's office. Buy the e-stamp before signing.

Registration

Not compulsorily registrable — a works document creates no interest in immovable property.

Notarisation

Not legally required. Notarising is sometimes done to fix the date of signing, which can matter if the timeline is later disputed.

Witnesses

Not legally required, but two witnesses are provided for below, given how often the facts of what was actually agreed are disputed only once work has started.
