When you need it

You are about to have construction, renovation or trade work done at your house or plot, and want the Contractor to state in writing that the safety of its workers, the insurance cover and any injury or accident on the job are its own responsibility, and that it will pay and protect you against claims. Use it with the House Construction Contract, the Interior Work Contract or the Trade Work Order, which carry only a short safety clause.

It does not replace insurance: ask for the policy papers and keep a copy. It cannot take away a worker's own rights under the law.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable as an undertaking or indemnity under the Indian Stamp Act, 1899 as applicable in Punjab or Chandigarh; the correct article and figure depend on how the instrument is classified. Confirm the current figure with the Sub-Registrar or the state revenue website (revenue.punjab.gov.in or revenue.chd.gov.in) before buying the e-stamp, and sign on the stamp paper.

Registration

Not compulsorily registrable — it creates no interest in immovable property.

Notarisation

Not legally required. Notarising fixes the date of signing, which is useful if an accident later raises a question of when the undertaking was given.

Witnesses

Not legally required, but two witnesses are provided for below.
