When you need it

You are having an old house or building pulled down and want the terms with the demolition contractor in writing. The Contract covers the extent of the demolition, who obtains the permission and disconnects the utilities, safety and care of neighbouring buildings, who removes the debris, who owns the salvage, the price and the handing back of the cleared site.

Not the application to the authority for permission to demolish — use the Demolition Permission Application for that. Not for the new building that follows — use the House Construction Contract.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable as an agreement, not a conveyance. PUNJAB: Article 5, Schedule I-A to the Indian Stamp Act, 1899 as applicable in Punjab, residuary rate under Article 5(c). Confirm the current figure with the Sub-Registrar or against revenue.punjab.gov.in. CHANDIGARH: the equivalent agreement article under the Chandigarh Administration's table at revenue.chd.gov.in; confirm at the Sub-Registrar's office, 30 Bays Building.

Registration

Not compulsorily registrable under section 17 of the Registration Act, 1908 — no interest in immovable property is created.

Notarisation

Not legally required. Notarising is sometimes done to fix the date of signing, which can matter if the start date or timeline is later disputed.

Witnesses

Not legally required, but two witnesses are provided for below, given the value that typically passes under a contract of this kind and how often the facts of what was agreed are disputed once work has started.

DEMOLITION CONTRACT

This Contract is made at Chandigarh on 2 April 2026

BETWEEN

Simran Gill, resident of House No. 302, Sector 9, Panchkula ("the Owner", which expression shall include the Owner's heirs, legal representatives and assigns), of the ONE PART;

AND

Safe Demolition Works, of Industrial Area Phase 1, Mohali, bearing registration/GST number X ("the Contractor", which expression shall include the Contractor's partners, legal representatives and permitted assigns), of the OTHER PART.

The Owner and the Contractor are together "the Parties".

1. THE SITE AND THE WORK

1.1 The Owner is the owner/allottee in possession of the building at House No. 302, Sector 9, Panchkula ("the Site").

1.2 Description of the structure: Old two-storey brick-and-lime house of about 2,000 square feet built-up area, with a boundary wall on three sides

1.3 The Contractor agrees to demolish the structure to the extent below, and to clear the Site, on the terms of this Contract ("the Work"). Extent of the Work: Complete demolition down to plinth level, including the boundary wall on the front side; foundations to be left in place

1.4 The Contractor shall not demolish anything outside the extent of the Work. The Owner shall give the Contractor access to the Site from the start date.

2. PERMISSION AND UTILITIES

2.1 The Owner has already obtained any permission needed from the concerned authority to demolish the structure.

2.2 Contractor to apply to the Municipal Corporation on the Owner’s behalf; fees reimbursed by the Owner against receipts

2.3 The Contractor shall not start the Work until the permission, where one is needed, has been obtained. The Work does not authorise any new construction on the Site; a new building needs its own sanctioned plan and contract.

2.4 The Owner shall have the electricity, water, gas and sewer connections to the structure disconnected before the Work starts.

3. SAFETY AND NEIGHBOURS

3.1 The Contractor shall plan and carry out the Work so that no person is injured and no property is damaged. The Contractor shall barricade the Site, put up warning signs, keep the public and the Owner's occupants away from the work area, and control dust and falling material.

3.2 Before the Work starts, the Parties shall jointly record the condition of the neighbouring buildings and shared walls by dated photographs or video, and each Party shall keep a copy.

3.3 The Contractor shall take special care of the following, and shall brace, prop or protect them as the work needs: Shared wall on the east side with House No. 304; boundary wall on the west side with House No. 300

3.4 The Contractor is responsible for, and shall repair at its own cost or pay for, any damage the Work causes to a neighbouring building, shared wall, road, drain or service line, and shall keep the Owner indemnified against any claim by a neighbour or other third party arising from the Work. The Owner shall tell the neighbours of the date the Work will start.
