When you need it

Use this when you were injured in a road accident involving a motor vehicle, or you are the wife, husband, child, parent or other legal representative of a person who died in one, and you want compensation from the driver, the owner and the insurer of the vehicle. Compensation claims of this kind are heard by the Motor Accident Claims Tribunal set up under the Motor Vehicles Act, 1988.

This is the claim petition: it names the petitioners and the respondents, tells the story of the accident, describes the injuries or the death, and states the compensation claimed and why the Tribunal has jurisdiction. A petition to a Tribunal is a court paper and is usually filed through an advocate, who will also settle the compensation claimed and draw up the papers the Tribunal asks for; the advocate's name goes at the foot if there is one. Tribunals may also require the claim in a prescribed form, a detailed accident report from the police, and the medical, income and loss records. Get these early: the FIR and charge-sheet or final report, the injury or post-mortem report, the medical bills, the proof of income and age, the death certificate where there is a death, and the insurance particulars of the vehicle. Pay any court fee the Tribunal's registry asks for; the document names no figure. A time limit for filing may apply; ask your advocate what it is today and file as soon as you can. Not for damage to a vehicle only — for that use the Motor Own-Damage Claim Letter. Not a claim under your own personal accident cover — use the Personal Accident Claim Letter. Not the sworn statement that goes with the petition — use the General Court Affidavit.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: a petition to the Claims Tribunal is a court paper. Any court fee is paid as the Tribunal's registry requires, and this document names no figure: confirm at the filing counter of the Tribunal whether a fee is payable and in what form, and whether the power of attorney or vakalatnama for the advocate needs a stamp.

Registration

Punjab and Chandigarh: not registrable. It is a petition to a Tribunal and touches no immovable property, so section 17 of the Registration Act, 1908 does not reach it.

Notarisation

Punjab and Chandigarh: the petition is verified by the petitioner at its foot. A supporting affidavit sworn before an oath commissioner or a notary is usually filed with it; see the General Court Affidavit.

Witnesses

Punjab and Chandigarh: no witness signs the petition. Witnesses are examined later, at the hearing.
