When you need it

Two vehicles (or a vehicle and a person) met in a road accident, nobody was killed, and the two sides have agreed an amount to settle the loss between them: usually the repair cost of the Claimant's vehicle, and sometimes a small sum for minor injury. This Deed writes down who was involved, the amount agreed, how and when it is paid, and that the Claimant will make no further money claim for the same accident once it is paid.

It is a private money settlement. It does not stop the police from acting on an FIR, and it does not bind a court or the Motor Accident Claims Tribunal. If an insurer is or may be asked to pay, tell the insurer before you sign: a settlement made without the insurer's knowledge can put the claim at risk, as the policy conditions say. Not for a claim for a death or a grievous injury, or one already pending before the Motor Accident Claims Tribunal, which need an advocate and the Tribunal's own procedure. Not for the letter that contests a traffic challan (use Challan Contest Representation).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is stated here for a settlement of this kind; it creates or transfers no right in property. Keep it on plain paper unless the person who asks for it names the article and the amount.

Registration

Not registrable under the Registration Act, 1908: it concerns a movable vehicle, not land or buildings. Any change to the vehicle’s registration record is made separately, at the Registering Authority.

Notarisation

Not required by law. A notary only records that the signatories appeared and signed, which makes it harder to deny a signature later. Carry original photo ID.

Witnesses

Two witnesses are sensible, each writing full name, address and ID reference beside the signature. A witness is an adult who is not a party to the document.
