When you need it

Use this when your own car, two-wheeler or other vehicle has been damaged in an accident and you want your motor insurer to pay for the repair under the own-damage cover of a comprehensive policy. It gives the policy and vehicle details, the date, place and how the accident happened, who was driving, whether the police were told, where the vehicle is, how you want it repaired, and where to pay.

It asks the insurer to register the claim, send a surveyor, and give any deduction in writing. Tell the insurer at once, by phone or email, and send this letter soon after; a late claim may be questioned. Do not repair the vehicle before the surveyor has seen it, except to stop further loss. Take dated photographs. Papers usually asked for: the claim form, policy copy, registration certificate, driving licence of the driver, repair estimate, FIR where required, and a cancelled cheque. Check the policy for the time within which a claim must be made and for any excess you bear. Not for a stolen vehicle — use the Motor Theft Claim Letter and Indemnity. Not a claim for injury or death to a person — use the Motor Accident Claim Petition or the Personal Accident Claim Letter. Not a challenge to a rejected claim — use the Appeal Against Claim Rejection.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A letter asking an insurer to perform its own contract creates, transfers or ends no right, so it is not a chargeable instrument under the Indian Stamp Act, 1899. Plain paper is enough.

Registration

Punjab and Chandigarh: not registrable. It touches no immovable property, so section 17 of the Registration Act, 1908 does not reach it. Keep proof of the day it was lodged: the stamped copy, the email delivery receipt or the post receipt.

Notarisation

Punjab and Chandigarh: no notarisation is needed. If the insurer asks for a sworn statement, it will say which of its papers it wants sworn.

Witnesses

Punjab and Chandigarh: no witness is needed. The signatory signs alone.
