When you need it

You live abroad and are sending money to a relative in India as a gift, such as to a parent, a spouse, a child or a brother or sister, and the receiving bank, or later the tax office, may ask for something in writing to show it is a gift and not a loan. This is a short gift deed and declaration, signed by you as donor and accepted by the relative as receiver, saying who gives what, how it is sent and that nothing is to be returned.

Not for a gift of land, a house or a flat — use the Gift Deed for Immovable Property for that, which has its own stamp duty and registration. For a donor's declaration alone, or a receiver's letter of acceptance alone, see the Donor Declaration for Gift and the Acceptance of Gift Letter.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A gift of money is a gift of movable property, not of land or buildings. Whether a stamp paper is needed for this kind of deed in Punjab or Chandigarh, and of what value, is for the Sub-Registrar or a local advocate to confirm; many banks and notaries ask for one anyway. Confirm the current position.

Registration

Not registered as a matter of course — a gift of money, unlike a gift of land or a building, is not usually registered. Confirm with a local advocate if the amount is large.

Notarisation

Notarisation is not stated here as a legal requirement, but the receiving bank often asks for it. If the donor signs abroad, a notary there may be needed, and the bank may ask for apostille or consular attestation too — confirm with the bank before signing.

Witnesses

Two witnesses are recommended. They should add their name, address and signature below the parties' signatures.
