When you need it

You have bought a used car or two-wheeler that already has a motor insurance policy running, and you want the insurer to record you as the new owner under that policy. This is your own covering letter to the insurer. It names the policy and the vehicle, says who sold it to you and when, and asks the insurer to move the policy into your name.

The seller adds a line of consent at the foot. Do this promptly after the purchase. The law gives the new owner only a limited time to have the policy transferred, and until it is done the cover for you as the owner can be doubtful. The insurer decides what papers and what fee it needs, and what happens to the seller's no-claim bonus; this letter only asks and sends the usual enclosures. Not for the transfer of the RC at the transport office (use RC Transfer Affidavit and the Car / Bike Sale Agreement). Not for a claim on the policy, and not for taking a fresh policy in your own name, which you can also do instead.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is stated here for a letter to an insurer; it creates or transfers no right in property. Keep it on plain paper unless the person who asks for it names the article and the amount.

Registration

Not registrable under the Registration Act, 1908: it concerns a movable vehicle, not land or buildings. Any change to the vehicle’s registration record is made separately, at the Registering Authority.

Notarisation

Not required. Some insurers ask for the signatures on the enclosures to be self-attested; carry original photo ID.

Witnesses

No witness is needed. The buyer signs the letter and the seller signs the consent.
