When you need it

Use this when an owner gives a property to a broker to sell or let, and the broker wants the facts written down and signed by the owner: address, description, asking price, how the owner holds it, who is in it, any loan, papers available and dues. It protects the broker from being blamed for what the owner said, and gives buyers a straight record.

Not the Client Requirement Sheet, which records what a buyer wants. Not an engagement or brokerage agreement; this sheet says it is not. Not the Seller's Disclosure Statement, which the seller gives a buyer.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty — a record of requirements, not an agreement to pay or to buy. Plain paper is enough.

Registration

Not registrable and not meant to be.

Notarisation

3. Owner's confirmation

The Owner confirms that, to the Owner's knowledge, the details above are true and complete, that the Owner has the right to offer the property, and that the Owner will tell the Broker at once of any change. The Owner allows the Broker to show the property to prospective buyers or tenants and to share these details, and photographs, with them.

4. What the Broker has and has not done

The Broker has written down what the Owner has said. The Broker has not checked the Owner's title, the papers, the loan or the dues, and nothing in this sheet is a statement by the Broker that they are right. A buyer or tenant should have the title and papers checked by an advocate before paying anything.

This sheet is not an agreement to pay brokerage. Any brokerage is settled in a written engagement agreement, if the parties make one.

Personal data

The names, addresses, telephone numbers and email addresses in this document are collected only for the purpose of this document and the transaction it records. Each party keeps a copy. A party may ask the other to correct it or, once the purpose has ended, to erase it, as the Digital Personal Data Protection Act, 2023 allows.
