Why you need it

When you need it

Paid a fee and the deal fell through? Refund depends on the fee agreement's failure terms and why it failed. Records why, amounts paid/refunded and when, and why the broker keeps anything. Once paid, it's final — unless the deal is later revived.

See stamp duty, registration and witnesses

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A refund agreement, no property interest — Article 5, Schedule I-A, Stamp Act 1899 (PB/CH), a small fixed sum. The closing receipt is separately chargeable under Article 53: above Rs 5,000, a one-rupee stamp.

Registration

Not registrable: s.17, Registration Act, 1908 needs a Rs 100+ property interest created; this creates none. Optional under s.18, pointless.

Notarisation

Not required — witnesses already prove signing.

Witnesses

Recommended for the agreement, since the reason for failure is what disputes turn on; not needed for the receipt.
