When you need it

A birth or death certificate carries a mistake — a wrong name, a wrong date, a parent's name that is missing or misspelt, or a spelling error — and you are applying to the Registrar of Births and Deaths for the area (the local body or health office that keeps the register, reached in Punjab through a Sewa Kendra or the local body's office, and in Chandigarh through the Municipal Corporation or an e-Sampark centre) to correct the entry and issue a corrected certificate. The Registrar will usually ask for a sworn affidavit setting out the error, how it arose and the documents that show the right particulars.

The choice of birth or death is made in the questions and the text follows it. Not for a birth that was never registered — use the Delayed Birth Registration Affidavit or the Non-Availability of Birth Certificate Affidavit. Not for a death that was never registered — use the Delayed Death Registration Affidavit. Not for a change of a child's name by choice rather than to fix an error — use the Minor Name Change Affidavit. Not for a wrong date of birth on other papers — use the Date of Birth Affidavit.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17.

Registration

Not a registrable instrument. Filed with the application for correction before the Registrar of Births and Deaths, who decides whether to correct the entry, may ask for the original certificate and further proof, and issues the corrected certificate. There is no Sub-Registrar step.

Notarisation

Sworn before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner. If the office that will receive it has its own practice about where and how the affidavit is sworn, confirm with that office first.

Witnesses

None required by law for the affidavit itself; it is authenticated by the notary's or Oath Commissioner's seal alone.
