When you need it

A birth was not registered within the twenty-one days the Registration of Births and Deaths Act, 1969 ordinarily allows, and a delayed registration application needs a sworn affidavit to go with it — the Act itself requires one once the delay passes thirty days. Between thirty days and one year after the birth, this affidavit accompanies an application for the Registrar's written permission to register it, together with the prescribed fee.

Beyond one year, it accompanies an application to a Magistrate of the First Class, who alone can order registration at that point, after verifying the birth. Confirm which of the two bands applies to your dates before filling this in, and expect the Registrar or the Magistrate to ask for independent proof of the birth — a hospital record, a doctor's or midwife's certificate, an immunisation or Anganwadi record — alongside this affidavit, not in place of it. A late-registered birth certificate is frequently asked for at school admission, for a passport, or for a government scheme, so check what that particular use needs before relying on this affidavit alone. Not for a birth you can still register within the ordinary twenty-one days, or within thirty days on payment of a late fee alone — neither needs this affidavit.

What follows is written for Punjab and Chandigarh. Stamp duty

A general affidavit, chargeable under Article 4 (Affidavit) of Schedule 1-A of the Indian Stamp Act, 1899 as applicable to Punjab, and under the corresponding entry of that Schedule as applicable to the Union Territory of Chandigarh — commonly a small fixed value, typically Rs 10, on non-judicial stamp paper or an e-stamp certificate. Registration

This affidavit does not itself register anything — it supports the application that gets the birth entered on the register kept under the Registration of Births and Deaths Act, 1969. Between thirty days and one year after birth, that application goes to the Registrar for written permission under sub-section (2) of section 13 of that Act; beyond one year, it goes to a Magistrate of the First Class for an order under sub-section (3). Either way, the birth certificate the Registrar issues once the entry is made — not this affidavit — is the document schools, passport authorities and other offices later ask for.

Notarisation

For a delay of between thirty days and one year, section 13(2) of the Registration of Births and Deaths Act, 1969 itself requires this affidavit to be made before a Notary Public or another officer the State Government has authorised for the purpose — this is not optional formality, it is a condition the Act attaches to the permission. Beyond one year, no such requirement appears in the text of section 13(3) itself, but a notarised affidavit is standard practice in support of the application to the Magistrate. Sign only in the attesting officer's presence.

Witnesses

Not compulsory for the affidavit itself. The Registrar or the Magistrate will ordinarily also want independent proof of the birth — a hospital discharge summary, a doctor's or midwife's certificate, or an immunisation or Anganwadi record — which this affidavit accompanies rather than replaces.

AFFIDAVIT FOR DELAYED REGISTRATION OF BIRTH

I, Simran Kaur, mother of the child named below, resident of House No. 55, Guru Nanak Nagar, Jalandhar 144001, do hereby solemnly affirm and declare as under:

1. That I am the deponent above named and am competent to swear this affidavit.

2. That a male child, named Ekam Singh, was born on 1 April 2026 at Civil Hospital, Jalandhar, to Gurmail Singh (father) and Simran Kaur (mother), then residing at House No. 55, Guru Nanak Nagar, Jalandhar 144001.

3. That the fact of birth is evidenced by a hospital discharge summary or birth record

4. That this birth has not previously been registered under the Registration of Births and Deaths Act, 1969.

5. That the birth could not be registered within the twenty-one days ordinarily allowed under that Act because The birth occurred at home in a village with no ready access to the Registrar's office, and the family was unaware that registration within twenty-one days was compulsory.

6. That the date of birth falls between thirty days and one year from the date of birth, so that registration requires the written permission of the Registrar (or other officer prescribed for the purpose) and this affidavit, under sub-section (2) of section 13 of the Registration of Births and Deaths Act, 1969

7. That I request the Registrar (Births & Deaths), Municipal Corporation, Jalandhar, the State of Punjab, to register this birth accordingly.

8. That the contents of this affidavit are true and correct to my knowledge, no part of it is false, and nothing material has been concealed therefrom.
