When you need it

A person's birth was never registered, so there is no birth certificate, and an office — most often for a passport or a visa file — asks for a sworn statement saying so, together with other proof of the date of birth. It is for use where you can show that no record exists (for example after a search at the local body or Gram Panchayat in Punjab, or at the Municipal Corporation or an e-Sampark centre in Chandigarh) and you are relying on documents such as a school certificate instead.

Not for registering the birth itself, which is done through the Registrar of Births and Deaths — use the Delayed Birth Registration Affidavit for that. Not for correcting a birth certificate that exists but is wrong — use the Birth or Death Certificate Correction Affidavit. Not for stating a date of birth that differs between ordinary papers — use the Date of Birth Affidavit.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17.

Registration

Not a registrable instrument. It is handed to the office that asked for it (for example the passport office) with the other documents named in paragraph 3.1. It does not register the birth and there is no Sub-Registrar step.

Notarisation

Sworn before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner. If the office that will receive it has its own practice about where and how the affidavit is sworn, confirm with that office first.

Witnesses

None required by law for the affidavit itself; it is authenticated by the notary's or Oath Commissioner's seal alone.
