When you need it

Your signature on a bank account, a share folio, a property record or an application no longer matches the one you sign today, and the bank, registry or office has asked for a sworn statement that both signatures are yours, or that your new signature should be recorded in place of the old one. The affidavit describes where each signature appears, explains the difference, and carries a specimen of each for the office to compare.

Not for a change of name — use the Gazette Name Change Application or the Aadhaar Name/DOB Correction Declaration according to which record is concerned. Not for a signature that someone else made or that you deny having made, which is a matter for the bank or the police and not for this document.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17.

Registration

Not a registrable instrument. It is handed to the bank, registry or office that asked for it, which compares the specimens with its own record and decides whether to change the signature on file. There is no Sub-Registrar step.

Notarisation

Sworn before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner. If the office that will receive it has its own practice about where and how the affidavit is sworn, confirm with that office first.

Witnesses

None required by law for the affidavit itself; it is authenticated by the notary's or Oath Commissioner's seal alone.
