When you need it

Your name or date of birth on your PAN does not match your other identity documents such as Aadhaar, passport or school certificate, and a PAN correction, a bank, or an income tax or KYC process asks you to state, on oath, which particulars are correct and how the mismatch arose. The affidavit sets out what the PAN now says, what is right, the documents that prove it, and that you hold one PAN only.

Not for a lost, damaged or unreceived PAN card, which needs a reprint and not a correction. Not for correcting an Aadhaar card — use the Aadhaar Name/DOB Correction Declaration. Not for a name change by marriage or by deed poll — use the Gazette Name Change Application first, and then update the PAN.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: Article 4, Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab, non-judicial stamp paper, commonly Rs 10, e-stamped via SHCIL (shcilestamp.com) or bought from a licensed vendor. Chandigarh: Article 4, Schedule I to the Indian Stamp Act, 1899 as extended to the Union Territory, the same nominal denomination, from SHCIL or the Treasury, Sector 17.

Registration

Not a registrable instrument. Submitted, or kept ready, with the PAN correction application and the supporting documents. Keep the acknowledgement number issued when the application is filed. There is no Sub-Registrar step.

Notarisation

Sworn before a Notary Public (Notaries Act, 1952) or an Executive Magistrate/Oath Commissioner. If the office that will receive it has its own practice about where and how the affidavit is sworn, confirm with that office first.

Witnesses

None required by law for the affidavit itself; it is authenticated by the notary's or Oath Commissioner's seal alone.
