When you need it

You are a parent or legal guardian applying for an Aadhaar or a PAN for a child, or updating or correcting the child's existing one, and the centre, portal or office wants a signed declaration that you act for the child, who the child is, and which document shows the child's name and date of birth. The choice between Aadhaar and PAN, and between a new application and an update, is made in the questions.

Not for correcting your own Aadhaar or PAN — use the Aadhaar Name/DOB Correction Declaration or the PAN Correction Affidavit. Not for a child's name change by choice — use the Minor Name Change Affidavit. Not for travel consent — use the Parents' Consent for a Minor Travelling Abroad.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A plain declaration of this kind carries no fixed stamp duty of its own, and the authority does not need it on stamp paper. Where a centre, office or notary insists on stamp paper before attesting it, as a matter of local practice rather than law, it is bought as a non-judicial stamp paper of the smallest denomination available from a treasury, an SHCIL e-stamp counter or an authorised vendor in Punjab or in Chandigarh; confirm the denomination at the counter.

Registration

This declaration is submitted to the authority with the application and is not an instrument the Registration Act, 1908 requires to be registered, in Punjab or in Chandigarh. Keep the acknowledgement or request number that the portal or centre issues; that number, not this declaration, tracks the application.

Notarisation

The portal or centre may accept the declaration with a plain signature, or may ask for it to be notarised before a Notary Public or an Oath Commissioner for Punjab or for Chandigarh; ask the particular centre or office before you go.

Witnesses

No attesting witness is required by law for the declaration itself; confirm with the particular centre or office.
